Regular Business Meeting
May 7, 2007

Attendance:  Mark Schwab, Chairman
                    Mark Hickey, Vice-Chairman
                    Duane Jenkins, Trustee
                    Susan Denbow, Fiscal Officer

The meeting was called to order at 7:34pm by Chairman Mark Schwab followed by the Pledge of Allegiance.

Duane Jenkins stated that he had several corrections and additions to the April 2 minutes and would email or fax them to the fiscal officer.  The minutes were tabled.

Duane Jenkins stated that there were also additions to the minutes of April 16 and turned in a CD of the meeting that he had made from his taping.  He stated that he would like to see the fiscal officer go back to taping the meetings.  The minutes were tabled.

Duane Jenkins moved to pay the bills with a second by Mark Schwab.  Roll call all yes.

Fiscal Officer Report

Fiscal Officer Susan Denbow presented the bank reconciliation for April to be reviewed by the trustees.  She advised that there was a $.40 error that would be corrected with the bank.  After review, the trustees signed the reconciliation.

Fiscal Officer Denbow presented the monthly reports for April along with a current appropriation ledger for the trustees to review.  The trustees signed that they had received their copies of the reports.

Fiscal Officer Denbow had the following announcements:
     *Ashland County Regional Planning-meeting on May 9
     *Ashland County Regional Planning-CDBG Program reallocation of 2006 funds of $13,100.

Fiscal Officer Denbow advised that she had received the 2007 annual fee assessment from the Petroleum Underground Storage Tank Release Compensation Board.  Mark Schwab stated that he would check with AJ Singh to see who pays this fee.

Fiscal Officer Denbow stated that she had received the new OTARMA policy and had insurance cards to be placed in each of the township vehicles.

Trustee Reports

Mark Schwab advised that the renovations to the gas station were going well but they had run into unexpected damage on the west side of the building.  He made a motion to allow an additional $2000 to cover the cost of these repairs which was seconded by Mark Hickey.  Roll call all yes.

Mark Schwab gave the following updates:
     *Census Bureau inquiry had been completed and returned
     *State Auditors letter of arrangement had been signed and returned
     *20 Memorial Flags had been purchased and delivered
 
Mark Schwab advised that the records room safe had been drilled and repaired.  He stated that no zoning records were found but that it did have historical documents and other items in it.  Mark suggested that the new combo be placed somewhere inside the records room so that it is not lost again.  Duane Jenkins suggested making an inventory of the safe contents so that future township officials will know what is in the safe.  Mark S stated that he could meet with Duane on Saturday to do the inventory.

Mark Schwab stated that he was still gathering information on a new community sign and would have it at the next meeting.

Mark Schwab gave a report on the clean up day.  Brown’s Trash removed a total of seven 20 yard dumpsters, two 14 yard dumpsters and a compactor truck in addition to the recycle steel trailer that was overflowing.  The tire trailer was filled with 768 regular tires, 6 tractor tires and 100 truck tires from the township residents.  Ted Regal was able to fit in 50 tires.  A big thank you to all who helped including Randy Young at the tire trailer and the Ladies Auxiliary who provided food and drinks to the workers.

Mark Schwab stated that he thought the door on the township garage needed to be replaced with a new door and frame.  Mark Hickey will get estimates on the cost.

Mark Schwab advised that he would be completing the request to proceed paperwork for the Twp Rd#581 project.

Mark Hickey advised that D&D Emulsions had the storage tank ready for pick up.  Mark made a motion to purchase 4200 gallons of dust bond at a cost of $8000 to do two applications.  Mark Schwab seconded with roll call all yes.

Mark Hickey stated that the regional planning meeting would be held at 8:00pm on May 9th and that they would be a discussion on forming a county planning organization to replace regional planning.  Mark read a letter that gave the reasons why they would like to make this change.  Anyone interested or having questions about this is encouraged to attend the meeting.  Mark Schwab stated that he was interested in attending.

Mark Hickey advised that AJ Singh was unable to attend this meeting but had sent the rent check for May.

Mark Hickey stated that he had attempted to secure block grant money for the roof of the Kno Ho Co building.  The contractor was not interested when asked to submit a prevailing wage statement.  Mark will check into possible money for sidewalks in town.

Duane Jenkins stated that he had checked into the possibility of a tax levy or bond levy for a new fire station and equipment.  He advised that the prosecutor’s office does not handle bond levies and the trustees would have to hire a firm to write the bond.  The initial cost would be $500 to write up the bond levy and additional charges for changes, etc. would not exceed $1400.

Duane Jenkins stated that he had received a call from Linda Fulk, the CDL coordinator for the township association.  He advised that no drug testing had been done because she had not received any reply to her request letters of last year and this year.  The fiscal officer advised that she had replied to last years request and had not received any other requests from Linda.  The fiscal officer will send the requested information to the CDL coordinator.

Duane Jenkins stated that he had received a call from Donna Riley who had been contacted by a funeral home concerning a burial.  The funeral home stated that they had not received a reply to the message they had left.  The fiscal officer advised that she had made a confirmation call to the funeral home.

Duane Jenkins stated that he was in favor of abandoning all zoning and starting again as Milton Township had done.  He stated that he did not want a possible lawsuit due to zoning issues.  Mark Schwab stated that he would not abandon zoning because we do have documentation and that there is a map and new resolution book ready to submit.  Duane stated that the township should expect a lawsuit.

Duane Jenkins presented a request from Gary Hollingsworth for copies of all of his time sheets from January 2006 to present.

Duane Jenkins presented a request from Gary Hollingsworth for 150 feet of 12” pipe at a cost of $5.25/ft to install a catch basin at the corner of Twp Rd#581 and Twp Rd#462.  Mark Hickey suggested purchasing additional 12” culvert pipe to use in other repairs.  Mark Hickey moved to purchase $1000 of 12” pipe with a second by Duane Jenkins.  Roll call all yes.  Mark Schwab stated that the work needed to be completed in 3 weeks so that the Twp Rd#581 project could be started.

Duane Jenkins stated that 2 prior disciplinary actions had been signed in executive session which violates open meeting laws.

Mark Schwab moved to enter executive session at 8:34pm to discuss the previous disciplinary actions with a second by Mark Hickey.  Roll call Schwab-yes, Hickey-yes, Jenkins-yes.

Mark Hickey moved to return to regular business meeting at 8:46pm with a second by Duane Jenkins.  Roll call Schwab-yes, Hickey-yes, Jenkins-yes.

Mark Schwab announced a 15 minute recess.

Duane Jenkins stated that the township needed to have random drug testing done on employees who operate township equipment.  Mark Schwab stated that this should then include all fire department volunteers who drive the trucks and squads.  Duane stated that testing was required by OTARMA and everyone needed to have a drug test done by Thursday.  Mark Schwab questioned why everyone would need one done at this time.

Mark Schwab stated that no decision had been made during the executive session and would be researched further.

Fire and EMS Report

There was no fire report.

Steve Denbow stated that the EMS had nothing to report.

Zoning Inspector Report

Zoning Inspector Janice Steele asked about attending the OTA Zoning Basics Program on June 15.  The cost is $30 per registration.  Mark Schwab moved to allow up to $450 for any trustee or zoning member to attend with a second by Duane Jenkins.  Roll call all yes.

Janice stated that there were pictures of the fire training class, tire round up and the trash clean up that would be put on the web site.

Janice advised that she had received a request from a resident about putting a “Welcome Home” message on the community sign for her husband returning from Iraq.  The trustees stated that they did not see any reason not to put the message on the sign.

Janice asked for input on the Veterans web page on the web site.  Everyone who had seen it felt that it was well done.

Open to Floor

John Kiley stated that he had the reflectors from the cemetery to return to the township garage.

Doug Wellock and Jim Maple were in attendance and requested information on zoning concerning the Shooting Challenge property.  They are interested in purchasing the property and business but need to know what zoning permits they will need.  Janice advised that they will need a conditional use permit and it will go to the Zoning Board of Appeals.  She will meet with them to get them any information they will need.

Pete Riley stated that he had heard that Mark Hickey was telling people that a culvert he had installed was not put in properly.  He stated that this interfered with his business and he wanted it to stop.  He advised that the copy of the building permit at the county health office had a notation that the culvert had not been approved.  Mark Schwab stated that Gary Hollingsworth had checked the culvert and that it had been approved.  Mr. Riley asked for a copy of the culvert regulations adopted by the trustees.  He was informed that it was the same one that he and the former trustees had approved.  Mr. Riley stated that the prior trustees had not adopted any culvert regulations but had used the same permit as the county used.

Pete Riley stated that he did not know how the trustees could enforce zoning resolutions when Mark Hickey did not have business permits and had junk vehicles around his place. 

Donna Riley made a request for copies of the payment register, January to date, the receipt register, January to date and the fund status report.

Bonnie Fagin stated that prior to spending money for and putting a bond levy on the ballot this fall, the trustees should check with the residents concerning their thoughts about a levy.  Duane Jenkins stated that he had spoken with some residents about the bond levy and they were interested.  Bonnie stated that she would like to see the trustees continue to make forward progress with the issues of the township.

Mark Schwab moved to adjourn at 9:46 pm with a second by Mark Hickey.  Roll call all yes.
