Regular Business Meeting
May 21, 2007

Attendance:  Mark Schwab, Chairman
                    Mark Hickey, Vice-Chairman
                    Duane Jenkins, Trustee
                    Susan Denbow, Fiscal Officer

The meeting was called to order at 7:34pm by Chairman Mark Schwab followed by the Pledge of Allegiance.

Duane Jenkins requested that the minutes of April 2 be corrected to show that he had voted no to the adjournment motion.  The minutes were corrected and initialed by the trustees.  Mark Hickey made a motion to accept the minutes as corrected with a second by Duane Jenkins.  Roll call all yes.

Duane Jenkins made a motion to accept the minutes of April 16 with a second by Mark Hickey.  Roll call all yes.

Duane Jenkins made a correction to the May 7 minutes.  They were tabled until rewritten.

Mark Hickey made a motion to pay bills with a second by Mark Schwab.  Roll call all yes.

Fiscal Officer Report

Fiscal Officer Susan Denbow read a letter from Thomas Wheland, President of Lodi Hospital, advising that he would like to attend the September 17 meeting of the trustees to give a report of the hospital’s accomplishments and future plans.

Fiscal Officer Denbow had the following announcements:
     *Northeast Ohio Township Association-meeting on May 31 in Mantua, Ohio
     *Ashland County Township Association-meeting on May 30 at Turk Bros.

Fiscal Officer Denbow stated that the State Auditors were completing the audit and would like to set up a post audit meeting.  The trustees stated that Wednesday evening May 23 at 7:30 pm would be alright or Thursday, May 31 at 7:30 pm.  The fiscal officer will check with the auditors.

Fiscal Officer Denbow stated that she had talked with Linda Fulk, the CDL Coordinator, about township employees with CDL’s.  All employees with a CDL have been added to the random drug testing pool of the township association.  The fiscal officer will be contacted if any employee is drawn for testing.

Trustee Reports
Mark Schwab advised that the request to proceed on the Twp Rd#581 project had been sent to the OPWC.  It should be returned prior to the next meeting so that the trustees can sign the contract with Lytle Construction.

Mark Schwab stated that the siding renovations had been completed on the gas station and looked very good.

Mark Schwab stated that AJ Singh was checking into the underground tank fees.

Mark Schwab advised that the Boy Scouts would be carrying 20 flags in the Memorial Day parade and then they would be placed at the cemetery.

Mark Schwab stated that the Ladies Auxiliary had added mulch to the landscape around the gazebo and would like reimbursement for 7 bags of mulch.  Mark Hickey moved to reimburse with a second by Mark Schwab.  Roll call all yes.

Mark Schwab asked questions about driveway culverts.  The present forms and application have no adoption date on them.  Mark will review them and present them for adoption at the next meeting.

Mark Schwab asked if the Kno Ho Co rent is paid monthly or annually.  The fiscal officer advised that it is paid annually but was unsure if paid at the beginning or end of the year.  She will check on this.

Mark Schwab stated that prior discipline was discussed at the executive session during the May 7 meeting.  He stated that he would not change any records already in employee’s files.

Mark Schwab stated that the fire department had requested to purchase a new squad and he had checked into the available funds.  Mark Schwab made a motion to purchase a new squad from Burgess Ambulance with money from the EMS fund.  He stated that the purchase would have conditions such as 100% EMS funding with no general fund money used, one old squad to be traded or sold, all purchases by the EMS would need trustee approval until the fund is built back to a reasonable amount and any funds borrowed from the general fund by the EMS would be paid back as soon as funding was available.  The trustees discussed the motion with input from Chuck Burgess via phone and the EMS lieutenant.  There was no second to the motion.

Mark Hickey advised that the storage tank had been delivered by D&D Emulsions.  He stated that it needed a 15’ section of hose to transfer the dust bond product at a cost of $219.  Mark Hickey moved to purchase the hose with a second by Duane Jenkins.

Mark Hickey stated that he had checked into cost for the garage door.  Prices included a residential style at $176, a commercial style at $160 and steel on steel style at $250.  The knob and lock would be an additional $80.  Mark Schwab moved to purchase the steel on steel door with knob and lock at a cost not to exceed $370.  Mark Hickey seconded with roll call all yes.

Mark Hickey stated that he had contacted Workman Roofing about the Kno Ho Co roof and would be checking into CDBG grant money for this project.

Mark Hickey advised that there would be a survey of the residents along State Route 58 inside the town limits to check into grant money to repair or replace the sidewalks in this area.

Mark Hickey stated that he had copies of the Regional Planning Commission minutes from their meeting.  A main topic of the meeting was the disbanding of the commission in favor of a County Planning Commission.  Mark stated that he did not favor this change but that the majority at the meeting had voted to disband.  He stated that the township would have to vote to withdraw from the Regional Planning Commission and would like any feedback from anyone interested.

Mark Hickey read a letter for public record from Kno Ho Co stating their appreciation for the driveway stone.

Mark Hickey read a rebuttal letter to the alleged ethics violations made at the April 16 meeting.

Mark Hickey stated that there were no first aid kits in the township road equipment.  He had purchased 3 on sale at $9.94 each and would like to be reimbursed if they are used.  Mark Schwab moved to reimburse with a second by Duane Jenkins.  Schwab and Jenkins-yes, Hickey abstained.

Duane Jenkins advised that he had received a complaint from resident Jerry Bauer concerning a smoking violation at the community room building.  Duane handed out a copy of ORC concerning the smoking laws.  Mark Schwab stated that he did not see where the township was in violation and was told that there was a smoking receptacle at the entrance of the building.  Mark Schwab moved to make the gazebo the designated smoking area and move the receptacle to the gazebo.  Mark Hickey seconded with roll call all yes.

Duane Jenkins stated that he would like to see posted speed limits on the township roads.  He will check into the process to do this.

Duane Jenkins stated that the township needed to implement a random drug testing plan.  Mark Schwab stated that there would have to be a policy written before they can start doing random drug tests.  Mark will work on writing the policy.

Fire and EMS Report

Chief Gary Hollingsworth reported that 5 new members had completed training and were certified.  He reported that he had completed his 240 firefighter class and passed his certification.

EMS Lieutenant Steve Denbow stated that Ohio Billing had contacted him about not receiving any recent billings.  He will check on this and take care of it. 

Lieutenant Denbow stated that several EMT’s had attended the EMS appreciation banquet and the department had received an appreciation plaque from Lodi Hospital.

Zoning Inspector Report

Janice Steele stated that she had turned in her report and would like to know how to proceed with the Sas issue.

Janice reported that she had given information about the zoning basics program to the commission board but had not heard anything back from them.

Road Supervisor Report

Gary Hollingsworth reported that the flagpole in the memorial park had been restrung and he had replaced the flag.  Mark Hickey stated that he would try to get the top section covered with tape to prevent future problems until the flagpole can be replaced.

Gary Hollingsworth requested to purchase more 12” culvert pipe to make repairs.  Mark Hickey moved to purchase $500 of culvert pipe with a second by Mark Schwab.  Roll call all yes.

Mark Schwab inquired about the amount of stone used on the catch basin project on Twp Rd#581.  Gary advised that he used about 25 ton to complete the project.

Duane Jenkins requested to take a 5 minute break.

Mark Schwab stated that he had information on the cost of a new community sign.  One was from NorthCoast in Medina, Ohio for $3460 installed and from Cornerstone in South Carolina for $4382 not installed. 

Open to Floor

Janice Steele stated that she was against the disbanding of Regional Planning.

AJ Singh thanked the trustees for the improvements to the gas station and turned in the rent check for June.

Peggy Skinner turned in three registrations from zoning board members who would like to attend the zoning basics program.  She requested a spending form to purchase copy supplies.

Donna Riley stated that the October 2, 2006 minutes stated that Bates Garage had removed the culvert from the Twp Rd#150 replacement project.  In the November 20, 2006 minutes, it stated that the culvert had been sold to Ray Dilley for scrap price of $100 yet Mark Hickey had written the check for the $100.  Donna asked why Mark had paid for the culvert and the money had been put into the general fund.  Mark Hickey stated that he had written a check so that it could be recorded immediately and that Ray Dilley had reimbursed him for the money.  Donna stated that she wanted a copy of the reimbursement.

Tabitha Palm asked what the speed limit would be for the township roads.  She stated that the condition of some of the roads prevented them from being safely traveled at any speed.

Ron Blessing asked about the thickness of the grindings placed on Twp Rd#462.  He stated that they were nothing but a washboard.  Mark Schwab advised that there was looseness in the grader blade that needed to be repaired at a cost of about $15000 but that they could not take it out of service at this time due to the amount of roadwork needing done. 

There was a brief discussion concerning road issues, speed limits and weight limits and children safety.  Mark Hickey moved to purchase 2 more Children at Play signs to be used on Twp Rd#462.  Duane Jenkins seconded with roll call all yes.

Mark Schwab moved to allow Peggy Skinner to spend up to $80 at Irwin’s for ink cartridges and paper for the zoning board.  Duane Jenkins seconded with roll call all yes.

Mark Schwab moved to adjourn at 10:14pm with a second by Mark Hickey.  Roll call all yes.
