Regular Business Meeting
July 2, 2007

Attendance:   Mark Schwab, Chairman
                     Mark Hickey, Vice-Chairman
                     Duane Jenkins, Trustee
                     Susan Denbow, Fiscal Officer

The meeting was called to order at 7:30pm by Chairman Mark Schwab followed by the Pledge of Allegiance.

Mark Schwab moved to pay bills with a second by Duane Jenkins.  Roll call all yes.

Mark Schwab moved to approve minutes of June 4 meeting with a second by Mark Hickey.  Roll call all yes.

Duane Jenkins moved to approve minutes of June 18 meeting with a second by Mark Schwab.  Roll call all yes.

Fiscal Officer Report

Fiscal Officer Susan Denbow stated that Joel Hawley had requested a refund of building permit #032906 for $200.  The trustees tabled this matter until it can be checked into.

Fiscal Officer Denbow stated that Ted Regal had only gotten 50 tires onto the trailer and had asked about payment.  The trustees stated that the cost would be the $1 per tire fee.  He will send a check to the township.

Fiscal Officer Denbow stated that the cost to attend the OTA Summer Conference was $40 and the room would be $92/night.  She would like to attend Wednesday thru Friday.  Mark Schwab moved to approve the expense with a second by Mark Hickey.  Roll call all yes.

Fiscal Officer Denbow stated that she had received a flyer from ThomsonWest about a zoning bulletin subscription for $168.  This was given to the zoning inspector to check into.

Fiscal Officer Denbow had the following announcements:
     *Lytle Construction would be starting on Twp Rd#581 the week of July 9
     *Ashland Regional Planning-meeting July 11
     *Zoning Basics Workshop-rescheduled for September 21 or September 24.  Mark Hickey, Mark Schwab and Janice Steele would like to attend on September 21.
     *Steve Neff had returned a binder on the fire truck skid unit and turned over 2 checks that had been reissued after the lawsuit settlement.
    
Fiscal Officer Denbow advised that she needed another resolution for the trustees pay from January 1 thru June 30, 2007.  Mark Schwab made a resolution to pay trustees Mark Schwab and Mark Hickey 75% from general fund and 25% from road and bridge fund retroactive to January 1, 2007 thru June 30, 2007 with a second by Mark Hickey.  Roll call Schwab-yes, Hickey-yes, Jenkins-yes.

Fiscal Officer Denbow stated that the trustees needed to set a date for a budget hearing to review the budget for 2008.  The hearing was set for July 16 at 9:30 pm to follow the regular business meeting.

Fiscal Officer Denbow stated that she had received notice of LTAP trainings available.  These will be checked into to see when either of the road employees could attend.

Fiscal Officer Denbow stated that she would need any items for the newsletter by the end of the week so that it can be mailed next week.  Mark Hickey turned in a letter for the newsletter.

Trustees Report

Mark Schwab stated that he had sent a letter back to the Health Department concerning the no smoking violation notice.

Mark Schwab asked road supervisor Gary Hollingsworth about a time sheet for Paul Lower concerning a starting time.  Gary stated that Paul had been picking up trash and was using his personal vehicle.

Mark Hickey stated that the Kno Ho Co building had been transferred into the townships name.

Mark Hickey advised that Lodi Lumber had quoted the wrong price for the garage door.  It had not included the door frame and hardware.  The correct price for an all steel door and frame is $531.  Mark Schwab moved to approve an additional $250 to cover the cost of the door, frame and hardware.  Mark Hickey seconded with roll call all yes.

Duane Jenkins passed out copies of the estimated homeowner cost of a bond levy.  The copies showed the cost of both a $400,000 bond and a $300,000 bond.  The cost would be about $6.60 per $100,000 of home value for the $400,000 bond.  Duane explained the procedures and deadlines that needed to be done if a bond levy is placed on the November ballot.  The trustees decided to check into the $400,000 bond levy further and make their final decision at the next meeting.

Duane Jenkins advised that there were two HB being considered that could affect the township.  HB50 addressed the townships ability to remove junk vehicles and HB102SB would deal with township speed limits.

Duane Jenkins asked if the townships tables and chairs had been located and returned.  He was advised that they had.  A policy will be written concerning the use of the tables and chairs.
Fire and EMS Report

Fire Chief Gary Hollingsworth stated that the department would be taking 2713 and 2722 to the Spencer 4th of July parade.

No EMS report.

Zoning Inspector Report

Janice Steele reported that it appeared that some type of excavation had been started at the property of Country View Baptist Church.  She is checking into it.

Janice stated that she is also checking into some legal issues concerning a property on Co Rd #500.

Road Supervisor Report

Gary Hollingsworth stated that he had residents requesting the township install their culverts.  It was made clear that the township can only repair or replace culverts that are causing damage to the road.  Some culverts were discussed that are too small to handle the water flow and cause water to back up onto the road.  Gary will check this out.

Gary requested to purchase temporary road work signs.  Duane Jenkins moved to approve the purchase of 4 “road work ahead” and 4 “mowing ahead” signs along with 8 stands.  Mark Schwab seconded with roll call all yes.

Gary requested to purchase 2 flasher bulbs at a cost of $27.50 each.  Duane Jenkins moved to purchase with a second by Mark Hickey.  Roll call all yes.

Gary stated that he needed 10 scarfire teeth for the grader at a cost of $9 each.  Mark Hickey moved to approve with a second by Mark Schwab.  Roll call all yes.

Mark Hickey reminded Gary to use the grindings at Station 2 prior to the Chicken BBQ on July 28.

Open to Floor

AJ Singh turned in the July rent check.

John Kiley asked who he needed to contact about a cemetery plot.  He was told that the fiscal officer took care of it.

Robert Palm stated that there was improvement on the other roads since completion of the work on Twp Rd#581.

James Riley asked about the copies he had requested and was told that he would have to make payment prior to receiving them.  He was given an invoice of the cost.  Mr. Riley questioned Mark Hickey about a culvert and driveway.  Mark informed him that he had only done the driveway work and did not know who had installed the culvert.  Mr. Riley asked if he would be charged for copies of minutes and was told that they are available on the website.  He also asked if there had been alterations of time sheets by the trustees and was told that the trustees had not changed any time sheets.  Mr. Riley asked why the double payment to ADS had not been discussed at a public meeting and was told that it was simply an error and had been corrected.  Mr. Riley asked if the “clerk” had documented his complaint about Mark Hickey concerning junk and business permits and was told that it had been noted in the minutes.  Janice Steele advised that she had issued a complaint letter to Mark.  Mark Hickey stated that he had responded to the complaint letter sent by Janice.  Mr. Riley stated that if Duane Jenkins was taping the meetings then the tapes were public record and he could get a copy if he requested it.  Duane stated that he would make a copy for the records room.

Donna Riley asked why she was being charged for postage in addition to the copy cost.  She stated that she had not been charged in the past and had picked them up.  She was told that the trustees had made a resolution to charge for copies and postage and that she had not requested the number of copies prior to her last request.  The fiscal officer also stated that she had brought a previous request to several meetings before they had been picked up.  The trustees agreed to allow her to pay for the copies only this time and she could pick them up at the next meeting.  Donna turned in a check for $12.20.

Faye Schwab stated that if Duane taped the meetings then he should be responsible for making any requested copies.

Bonnie Fagen stated that she thought the fiscal officer was doing a great job especially since she is involved in other community organizations as well.

Mark Schwab moved to adjourn at 9:30pm with a second by Mark Hickey.  Roll call all yes.
