Regular Business Meeting
September 4, 2007

The meeting was called to order at 7:30pm by Chairman Mark Schwab followed by the Pledge of Allegiance.

Duane Jenkins made a correction to the minutes of the August 20 meeting and they were tabled until next meeting.

Duane Jenkins made a correction to the minutes of the July 16 meeting and stated that Mark Hickey wanted to review them also.  They were tabled until next meeting.

Mark Schwab moved to pay bills with a second by Duane Jenkins.  Roll call all yes.

Fiscal Officer Report

Fiscal Officer had the following announcements:
     *Paul Lower-medical release from doctor for return to light duty
     *Carl Taddeo-letter of resignation due to moving out of the township
     *Zoning Board of Appeals-meeting set for September 18 at 7:00pm (Janice Steele advised that it had to be changed to September 25 due to a member being out of town)
     *Ashland Regional Planning-meeting on September 12 at 8:00pm
     *Ashland County Prosecuting Attorney-letter and forms for HB “pay to play”
     *Petroleum Underground Storage Tank Board-certificates of coverage for township and Ohio Fuel Stop
     *State Farm Insurance-request for quote on fence damage at cemetery-Mark Hickey will get a quote from Farnsworth Fence to fax to them
     *ODOT-letter concerning installation of signs by townships on state highways
     *Zoning Workshops-both are full-confirmations should be coming in early September
     *W.W.Williams-request for credit application for work being done on fire trucks (trustees stated they did not see a need to set up a credit account, will pay when work is done)
     *Heritage Claim Service-request for fire report (turned over to fire chief)

Fiscal Officer Denbow presented two cemetery deeds to be signed.

Fiscal Officer Denbow provided the copy of the receipt register requested by Donna Riley.

Trustee Reports

Mark Schwab requested all bids received on the chip and seal project.  Fiscal Officer Denbow stated that she had not received any by mail but stated that the mail delivery had been interrupted due to the flooding of the Mansfield Post Office.

Mark Schwab stated that he had received new Zoning Board of Appeals forms to request a variance and for conditional zoning.  Mark Schwab made a resolution to adopt the form “Notice of public hearing to property owner (appeal requesting a variance)” with a second by Duane Jenkins.  Roll call Schwab-yes, Jenkins-yes.  Mark Schwab made a resolution to adopt the form “Notice of public hearing to newspaper (appeal for a variance” with a second by Duane Jenkins.  Roll call Schwab-yes, Jenkins-yes.  Mark Schwab made a resolution to adopt the form “Notice of appeal requesting a variance” with a second by Duane Jenkins.  Roll call Schwab-yes, Jenkins-yes.  Mark Schwab made a resolution to adopt the form “Revocation of conditional zoning certificate” with a second by Duane Jenkins.  Roll call Schwab-yes, Jenkins-yes.  Mark Schwab made a resolution to adopt the form “Notice of public hearing to property owner (application for a conditional zoning certificate)” with a second by Duane Jenkins.  Roll call Schwab-yes, Jenkins-yes.  Mark Schwab made a resolution to adopt the form “Notice of public hearing to newspaper (application for a conditional zoning certificate)” with a second by Duane Jenkins.  Roll call Schwab-yes, Jenkins-yes.  Mark Schwab made a resolution to adopt the form “Application for a conditional zoning certificate” with a second by Duane Jenkins.  Roll call Schwab-yes, Jenkins-yes.

Duane Jenkins made a resolution to adopt remedies to limit storage of junk vehicles per ORC 505.173.  He stated that this was in reference to complaint received from James Riley on August 20.  Mark Schwab stated that he would like to research the ORC and the recent HB to find out how the township can enforce them.  There was no second at this time and was tabled until the next meeting.

Duane Jenkins stated that OTARMA should be contacted and given the accident report number 03-0703-03.

Duane Jenkins stated that he had been contacted by Jerren Thompson with a complaint about a trustee calling him about a culvert multiple times at all hours of the evening.  He will be contacted and given a scheduled time at a trustee meeting to address his complaint.

Duane Jenkins stated that there was a request for legal opinion to the Attorney Generals Office concerning public records of tapes of meetings. 

Duane Jenkins asked if the tire fire report had been turned in by the fire chief.  He was advised that it had not been turned in yet.

Duane Jenkins stated that the request for legal opinion concerning Lytle Construction being able to bid on the chip and seal project had not been sent.  He stated that a resolution had been made at the August 6 meeting and Mark Hickey was to send in the request.  Mark Schwab will check with Mark Hickey on this.
Duane Jenkins turned in the invoice from Peck Shaffer.

Fire and EMS

EMS Captain Steve Denbow turned in a quote from Burgess for $116,227 that included a $4200 rebate from Ford for a 2008 squad.  Delivery of the squad would be after February 2008.  Mark Schwab asked about the warranty and Steve explained the warranties.  Duane Jenkins stated that he would like to check with OTARMA on insurance costs.  The decision was tabled until the next meeting.

Doug Campbell stated that Southern Lorain County Ambulance would have four different squads at their station tomorrow night at 6:00pm if any of the trustees or department members would like to check them out.

Fire Chief Gary Hollingsworth arrived at this time.  He turned in his report on the tire fire that the trustees had requested.

Zoning Inspector Report

Janice Steele stated that she was still looking for solutions to the two problems that she had presented at a prior meeting.  Mark Schwab stated that he was not sure they could find a solution.

Road Supervisor Report

Gary Hollingsworth stated that he had approximately 3/4 of the roads ready for chip and seal.  He will continue to work on the other sections to prepare them.

Gary stated that Paul Lower had returned to work but was limited to light duty and was to stay out of dirty conditions.  He is currently driving the dump truck on road projects.

Gary and the trustees discussed the need to get the ditch mowing completed.  It was decided to place an ad for a part time seasonal mowing person.  Mark Schwab moved to place an ad in the Ashland Times Gazette and the Wellington Enterprise for a mowing person with a second by Duane Jenkins.  Roll call all yes.

Duane Jenkins asked if Gary had checked into a plan to correct the flooding issue that Rob Messenger had discussed at the last meeting.  Gary advised that several things could be done to help with the flooding such as opening the ditch, a second cross over on the road, and enlarging the culvert.  Gary stated that this would have to be a project for next year.

Gary was asked if Lytle Construction would be doing anything about the problems in the first mile of Township Road#581.  Mark Schwab advised that they could do a possible skim coat down the center of the road where the problem was.  Duane Jenkins stated that he would check with Ed Meixner about solutions.
Gary stated that he had received a bid for the chip and seal project.  The bid from Sarver Paving was opened and read.  The total bid was $120,555.  The trustees discussed the bid and the available funds.  Due to the mentioned flooding delays of the mail, the matter was tabled until the next meeting.

Duane Jenkins stated that the trustees had requested fire department minutes be turned into the fiscal officer.  The fire chief was asked to get these copies turned in.

Duane Jenkins stated that with colder weather coming, the furnace in the records room needed to be addressed.  Gary stated that he had a new furnace in the recycle building that could be used.  It will be checked to see if it can be used.

Open to the Floor

James Riley read a portion of the August 6 minutes that referred to statements he had made.  He wanted it stated that he had said he would not buy another permit because of trustee Mark Hickey’s place.  He stated that the minutes read he had interrupted the fire chief during his report on the tire fire and asked Gary to give his report.  Chief Hollingsworth reported that it was an open investigation.  Mr. Riley stated that the fiscal officer was manipulating the minutes.

A resident stated that he would like to see the culvert replaced on Township Road #462 east of State Route 58 prior to the chip and seal.  He advised that the culvert was starting to fall apart.

Doug Campbell stated that the trustees should check into options for funding of a new squad and check other companies for best price.  Mr. Campbell turned in the water board minutes.

Mark Schwab made a motion to adjourn at 9:14pm with a second by Mark Hickey.  Roll call all yes.
