Sullivan Township Trustees Attendance: Mark Schwab, Chairman The meeting was called to order at 7:30PM by Chairman Mark Schwab followed by the Pledge of Allegiance. Mark Schwab stated that due to a complaint of noise during the meetings that made it difficult to take notes, one person will be recognized by the board and should stand while talking. Duane Jenkins moved to accept the minutes of the July 16 meeting with a second by Mark Schwab. Roll call Hickey and Jenkins yes and Schwab no. Mark Schwab stated that he would like a copy of the CD of the August 20 meeting and moved to table the minutes. Duane Jenkins seconded. Mark Schwab moved to accept the minutes of the September 4 meeting with a second by Mark Hickey. Roll call all yes. Duane Jenkins moved to accept the minutes of the September 17 meeting with a second by Mark Hickey. Roll call all yes. Mark Schwab moved to reimburse Peggy Skinner $100 for mileage to zoning workshop with a second by Mark Hickey. The fiscal officer corrected the amount to $52.72. Mark Schwab revised his motion with a second by Mark Hickey. Roll call all yes. Mark Schwab moved to pay bills with a second by Mark Hickey. Roll call all yes. Fiscal Officer Report Fiscal Officer Susan Denbow presented the August bank reconcilement for review. After review, the trustees signed the reconcilement. Fiscal Officer Denbow presented the monthly reports to each of the trustees. The trustees signed that they had received their copies of the reports. Fiscal Officer Denbow had the following announcements: The trustees discussed setting a date and time for Trick or Treat. It was set for Saturday October 27 from 6:00PM-7:30PM. The Ladies Auxiliary will be serving food, also. Fiscal Officer Denbow stated that she had received an invoice from FarmPlan in Spencer but did not know what was purchased. Gary stated that he had purchased culvert pipe. Fiscal Officer Denbow advised that when reviewing time sheets, she had found an error on Paul Lower’s. It indicated that his lunch ended at 12:00 but he did not start work again until 12:30. Gary Hollingsworth stated that Paul was back at work at 12:00. The trustees stated that Paul will be paid 1/2 hour of overtime on his next paycheck. Fiscal Officer Denbow stated that she had spoken with George Parks who would be interested in helping out on the roads on a part-time basis. He was an Orange Township roadman who recently retired. The trustees decided that it would be beneficial to have his application on hand if needed. Trustee Reports Mark Schwab stated that he had received a letter from the Ashland County Board of Elections requesting that the community room be available for November 6 elections. Gary Hollingsworth will make sure a telephone extension is available. Mark Schwab requested to be reimbursed for his mileage to the zoning workshop of 106 miles. Mark Hickey made a motion to reimburse the mileage with a second by Duane Jenkins. Roll call all yes. Mark Schwab inquired about a response from Jarren Thompson. Duane Jenkins stated that he had received a letter and would read it during his time. Mark Schwab stated that the new community sign was in assembly and should be delivered in 1-2 weeks. Mark Schwab stated that he had written a part-time job description but had forgotten to bring a copy. He will have it to review at the next meeting. Fiscal Officer Denbow asked if the part-time mowing person, Ken Webb, should be added to OPERS. The trustees asked her to check on this. Mark Hickey stated that a thank you letter had been sent to Mr. Heilman for the use of the fire pond property. The property will revert back to the Heilman family. Mark Hickey stated that he had written a letter to send to all parties with an interest in the property at 76 Twp Rd 581 concerning the repair of the culvert. The letter requested a reply by November 19. A correction was made and Mark will have copies to sign at the next meeting. Mark Hickey advised that the cemetery fence had been repaired by Farnsworth Fence. Mark Hickey inquired about Paul Lower attending the LTAP training in November since he will be recovering from surgery. Gary stated that his surgery is tomorrow, October 2, and that the doctors have indicated that he should be back to light duty in 3-4 weeks. Mark Hickey stated that resident Bonnie Fagen had called concerning a drain tile from the Kno Ho Co building that has caused a hole in her yard. He had checked on it and stated that it was due to a blow out in the tile. The trustees discussed whether they were responsible for the repair or the homeowner. James Riley stated that no funds or equipment could be used on private property. A prior incident on the Canfield property was repaired because of an agreement that allowed the township to drain water from the roadway across the property. Duane Jenkins stated that he thought they should get a legal opinion on this matter. Bonnie stated that she had a wedding in the near future and could not wait. After a discussion, Mark Schwab stated that the benefits of the repair were for the school and the township and not the property owner. Mark Schwab made a motion to repair the drain tile with a second by Mark Hickey. Roll call Schwab and Hickey yes, Jenkins abstained without a legal opinion. Mark Hickey stated that he had been contacted by the Troy Township trustees concerning a tri township ditching project for Township Road#150. The townships would work together and share manpower and equipment. Gary asked about some flooding and culvert issues on Township Road#150 and there was a discussion on possible solutions. Mark Hickey stated that they had about 1/2 tank of dust bond left and asked when Gary thought he would be finished so that the water valve could be removed. Gary stated that he should have it finished by November 1. Mark asked if the tank valve was lockable and Gary stated that it was. Gary will get a lock to put on it. Mark Hickey stated that it was getting to late to do chip and seal. The trustees will get bids in February so that it can be scheduled earlier before the companies are too busy. Duane Jenkins inquired about getting the zoning map certified by getting the depositions from the former trustees. He would like to get a legal opinion concerning having legal counsel at the depositions. During the discussion on the matter, it was decided that the trustees would like to have legal counsel present to ask the necessary questions. The trustees will check into finding legal representatives in the area that handle this type of matter. Duane Jenkins stated that he would like to contact OTARMA concerning the matter of a township constable. He asked the fiscal officer who the contact representative was for the township. The fiscal officer advised him it was Wendy French. Duane Jenkins read a Notice of ORC Violation letter that he had written. The trustees made some corrections and additions to the letter. Duane will present the new version at the next meeting. Duane Jenkins read the letter from Jarren Thompson concerning his culvert. James Riley requested a copy of the letter. Fire and EMS Report Fire Chief Gary Hollingsworth stated that he had no report. AJ Singh stated that he could not stay but wanted to drop off the rent check for October. EMS Captain Steve Denbow stated that the fire department had voted to reimburse members who worked squad detail for the home football games. Drivers would get $10 and EMTs would get $20 per game with a limit of 1 driver and 2 EMTs per game. The trustees stated that since there is only 1 game left, it should be taken back to the department and worked on for next year. Zoning Inspector Report Janice Steele turned in a request for an ink cartridge for her printer. Janice stated that there had been a complaint of noise at the amish sawmill on County Road#500. She had contacted the Health Department, State Health Department and the EPA but there was nothing they could do because there are no current zoning regulations on this. The only thing she could find was through OSHA concerning hearing protection for the workers. Janice stated that she would be able to open the community room early on November 6 for the election workers if she is given a key. Road Supervisor Report Road supervisor Gary Hollingsworth turned in quotes from JUDCO for speed limit signs stop signs and arrow signs. Mark Hickey asked if the township had gotten the reflective strips for the sign posts from the county department. Gary stated that the county had not been able to get a supply for the township. Mark Schwab stated that a resolution to adopt speed limits would need to be made prior to ordering signage and that he thought there was a 60 waiting period. Mark Hickey moved to purchase the arrow signs and the stop signs at a cost of $872.20 with a second by Duane Jenkins. Roll call all yes. Gary asked to be reimbursed for 2 bags of shop rags at $20 per bag that he had purchased from a guy known as the “ragman”. Mark Schwab moved to reimburse Gary with a second by Duane Jenkins. Roll call all yes. Gary advised that the ditch mower had broken down and needed a nut for repairs. He turned in a request by Ken Webb for mileage reimbursement of 22 miles. Mark Hickey moved to make reimbursement with a second by Mark Schwab. Roll call all yes. Gary advised that he was getting equipment ready for the winter months and needed a pair of skid shoes for the snowplow at $110 each and blade markers at $40 pair. Mark Schwab moved to make the purchases with a second by Duane Jenkins. Roll call all yes. Gary requested to purchase 3 flasher/warning beacons at $59.99 each. He needs one on the grader, one on the dump truck and would like one to have in the shop. Duane Jenkins moved to make the purchase with a second by Mark Schwab. Roll call all yes. Gary requested a PO for 1000 ton of 411’s ($10000.) to use on road projects. He would like to work on the intersection of Twp Rd#350 and Co Rd#281 to move the ditch back from the corner and add more berm. It would take him a couple of days. Mark Hickey moved to approve the PO for stone with a second by Mark Schwab. Roll call all yes. The fiscal officer also advised that Gary still had funds available on a prior PO for stone. Duane Jenkins inquired about repairs to the grader. Gary stated that there would probably be down time for the grader in mid November. He will check on getting it in for the repairs at that time. Open to the Floor Noah Hunter stated that the parking lot at the gas station was an improvement. Eric Bartok stated he could get more lights for the gazebo. He was told that it should be fine until after Halloween. Dave Spieker inquired about getting a fire extinguisher refilled and was advised that A&M Fire in Ashland was were the fire department takes them. He stated that he had an appeal to the Zoning Board of Appeals decision on the reopening of the Shooting Challenge. He stated that they did not follow procedure by not notifying all neighbors in writing of the meeting. It was not clear who he should turn his appeal in to and there was a 20 day deadline. Duane Jenkins made a resolution to allow Janice Steele to put a written and/or verbal request to Paul O’Reilly for an answer to Dave Spieker’s question of how to proceed. Mark Hickey seconded with roll call Schwab-yes, Hickey-yes, Jenkins-yes. Jim Dehlingberg from the Ashland County Council on Aging spoke about the services that they supply such as meals and transportation for elderly residents. He stated that they can also help anyone 60+ and a resident of Ashland County with writing their will or POA. Mr. Dehlingberg passed out information and asked for support of their levy on the November ballot. Bonnie Fagen stated that she thinks a copy of the applicable ORC should be attached to the violation letter and that a complaint should be checked into to make sure that it is a valid one. Bud Jantz stated that Harold Zager had spoke at a prior meeting concerning road patrol of the township during hunting season. The purpose of this road patrol is to help settle issues and complaints between hunters and property owners such as trespassing, illegal hunting, etc. The cost of the road patrol is about $600 per year and they would like to know if the township would be willing to pay half of this cost. The trustees stated that they thought it was a good idea and will check into how to handle this matter. Richard Johnson stated that Twp Rd#391 south of St Rte#224 was in bad shape with a lot of potholes. He stated that Gary needs to fill in all of the holes and not just a few big ones. Gary Hollingsworth stated that he would be taking October 11 as a personal day. Mark Hickey moved to adjourn at 10:10PM with a second by Mark Schwab. Roll call all yes.
