Regular Business Meeting
August 20, 2007

Attendance:  Mark Schwab-Chairman
                    Mark Hickey-Vice Chairman

The meeting was called to order at 7:35pm by Chairman Mark Schwab followed by the Pledge of Allegiance.

Duane Jenkins turned in a CD of all of the meetings that he had taped.  He requested that Mark Schwab turn in all of the tapes that he had made.  Mark stated that he would turn in any that he had not recorded over.

The minutes of the July 16 meeting were tabled as Mark Hickey had not received a copy of the taped meeting to review.

Duane Jenkins moved to approve the minutes of the July 23 Special meeting with a second by Mark Hickey.  Roll call all yes.

Duane Jenkins made a correction to the minutes of the August 6 meeting.  The fiscal officer made the correction to the copy of the minutes and asked that each trustee initial the correction.  Duane Jenkins moved to approve the minutes as corrected with a second by Mark Schwab.  Roll call all yes.

Mark Hickey moved to pay bills with a second by Mark Schwab.  Roll call all yes.

Fiscal Officer Susan Denbow stated that she had received a statement from NAPA in New London but could not verify the purchases that had been charged.  She contacted the store and was told that two men had come into the store and made the purchase but had not signed the invoice.  All trustees and road personnel stated that they had not made the purchase.  Mark Hickey made a motion to send a letter stating that the purchases were not made by the township and to close the account.  Duane Jenkins seconded with roll call all yes.

Fiscal Officer Report

Fiscal Officer Denbow presented the July bank reconcilement to be reviewed.  After reviewing it, the trustees signed the reconcilement.

Fiscal Officer Denbow presented the July monthly reports.  The trustees signed that they had received their copy of the reports.

Fiscal Officer Denbow had the following announcements:
     *Prosecuting Attorney Office-legal opinion concerning the fire pond
     *ThomsonWest-Ohio Rules of Court for $134
     *US Department of Commerce-Local Update of Census Addresses(LUCA) program training-September 18 from 9:00-2:00—also have computer based training on CD Rom
     *County Auditor-paperwork for tax exemption for KnoHoCo property filed
     *2007 IRS mileage reimbursement rate is $0.485-fiscal officer has new request forms

Fiscal Officer Denbow stated that she had received the amounts and rates of the tax levies to be certified.  Mark Schwab read the resolution to accept the tax rates with a second by Mark Hickey.  Roll call Schwab-yes, Hickey-yes, Jenkins-yes.

Fiscal Officer Denbow requested an executive session at the end of the meeting to review EMS accounts from Ohio Billing.

Trustee Reports

Mark Schwab stated that he had received an application from Bev Bolen as an alternate to the Zoning Commission Board.  After review, Mark Hickey moved to accept Bev as an alternate to the Zoning Commission Board with a second by Mark Schwab.  Roll call all yes.

Mark Schwab stated that he had received a complaint concerning an incident/tire fire involving members of the fire department.  He asked Fire Chief Gary Hollingsworth to provide a full report on the incident.  He would like to know what happened, who all was involved or present before, during, and after the fire, any disciplinary actions, and what has been happening since the fire.  He requested the report by the next trustee meeting.

Mark Hickey asked about insurance covering the repairs to the cemetery fence.  The fiscal officer is attempting to get the insurance information.

Mark Hickey stated that the chip and seal bid ad would be run in the paper on August 22nd, 24th, 27th.  It will cost $240 for the Ashland Times Gazette, $426.50 for the News Journal and $1287 for the Plain Dealer.

Mark Hickey reported that a culvert on Township Road#581 had caused erosion of the roadway.  He would like to see a copy of the culvert permit to pursue action to have this problem fixed.  He will check into the ownership of the property and will ask for a legal opinion if necessary.

Mark Schwab stated that he had spoken to Paul O’Reilly concerning Lytle Construction being able to bid on the chip and seal project and was told that it should not be a problem.  He advised that if Duane Jenkins still wanted a legal opinion, he could pursue it.

Duane Jenkins stated that he had read the letters from residents concerning speed limits on the township roads.  He stated that the opinions were about 50/50 with the cost of the signage being the biggest concern.  He advised that ORC 4511.21 allowed for the township to receive a fee for every ticket issued and that the township could have the sheriff’s office set up to enforce the limit.  Duane will get an estimate of the cost to put up signage including posts, signs, and labor.

Duane Jenkins stated that he had received a call from Ms. Pitz with concerns about the sewer plans.  He was advised that the EPA is not forcing the issue at this time and that there are currently no plans to pursue them although property is still being looked considered.  Mark Hickey stated that he will contact Ms. Pitz to let her know what is happening.

Duane Jenkins inquired about healthcare and disability for township employees.  He was advised that it is still being checked into.

Duane Jenkins asked about hiring a part-time road employee while Paul Lower is off due to injury.  He was advised that Paul had a doctors appointment on Tuesday and would know at that time when he could return to work.  Duane stated that they need to have someone to do the roadside mowing.

Duane Jenkins asked about the fire incident and was told that he will receive a copy of the report from the chief.

Duane Jenkins stated that he would like to see the meetings recorded.

Fire and EMS report

Chief Gary Hollingsworth reported that engine 2711 was still at WW Williams for repairs.  An air conditioner leak had been found and would cost $450 to repair.  Mark Schwab moved to make the repair with a second by Mark Hickey.  Roll call all yes.

EMS Captain Steve Denbow reported that Burgess would be getting 2008 model squads and would be priced about $3500 more for the same squad that was previously quoted.  The delivery date would be sometime around February 2008.  Steve will present the itemized bid at the next trustees meeting and asked if there was any other information the trustees would need to see.  Duane Jenkins stated that he needed to know that it had been approved by the fire department and that all officers were in agreement.  He stated that there would be no need for a new squad if half of the EMT’s were off the department due to disciplinary actions. 

Zoning Inspector Report

No report

Road Supervisor Report

Gary Hollingsworth requested to take vacation from August 27 to September 2.

Gary requested to purchase new blades for the road grader.  The cutting edges and bolts from Dexter would cost $382.55.  Mark Hickey moved to approve the purchase with a second by Mark Schwab.  Roll call all yes.
Gary was told that he had done a good job on the culvert repair project on Township Road#150.  He still has some ditching to finish.

Mark Schwab made a resolution to enter executive session at 9:25pm to review EMS billing accounts with a second by Mark Hickey.  Roll call Schwab-yes, Hickey-yes, Jenkins-no.  Duane stated that decisions could not be made executive session.  He was advised that due to HIPPA, the accounts could not be discussed in a public meeting.

Mark Schwab made a resolution to enter executive session at 9:26pm to review EMS billing accounts with a second by Mark Hickey.  Roll call Schwab-yes, Hickey-yes, Jenkins-yes.

Mark Schwab made a resolution to return to regular business at 9:40pm with a second by Mark Hickey.  Roll call Schwab-yes, Hickey-yes, Jenkins-yes.

Duane Jenkins made a motion to write off 5 of the EMS accounts and to continue collection on 7 accounts.  Mark Schwab seconded with roll call all yes.

Open to Floor

Donna Riley read a junk complaint letter from James “Pete” Riley concerning Mark Hickey’s property.  The letter was turned over to the trustees to pursue possible action for ORC/zoning violation.  Donna stated that she had not received a copy of the materials quote from Lytle Construction.  Mark Schwab advised that he had a copy and would fax it to her.  Donna requested a copy of the August receipt register.

Rob Messenger stated that a culvert on Township Road#150 west of Township Road#391 was causing flooding problems on his property.  Gary Hollingsworth stated that there were several factors contributing to this problem and will check into possible solutions.  They discussed possibly changing a 10” culvert to a 12” culvert and adding a culvert across the road to divert some of the water flow.

Roy Phillips stated that information on the HB dealing with township speed limits could be found at Ohio Township Roads-speed limits.

Faye Schwab stated that she would not want the EMS services disbanded.  They provide a valuable service to the township.

Mark Schwab moved to adjourn at 10:05pm with a second by Mark Hickey.  Roll call Schwab and Hickey-yes, Jenkins-no.
