Regular Business Meeting
March 17, 2008

Attendance:  Douglas Campbell, Chairman
                    Duane Jenkins, Vice-Chairman

                    Susan Denbow, Fiscal Officer

The meeting was called to order at 7:00PM by Chairman Douglas Campbell followed by the Pledge of Allegiance.

Mark Hickey moved to approve the minutes of January 25 with a second by Duane Jenkins.  Roll call all yes.

Mark Hickey moved to approve the minutes of February 4 with a second by Douglas Campbell.  Roll call all yes.

Douglas Campbell moved to accept the transcription of the public hearing/business meeting of February 22.  He stated that due to the length of the transcription, he had made only one copy.  Duane Jenkins and Mark Hickey requested copies with Mark Hickey making a motion to table them.  Duane Jenkins seconded.  Roll call all yes.

Mark Hickey made corrections to the minutes of March 3.  Douglas Campbell moved to approve with corrections and Duane Jenkins seconded.  Roll call all yes.

Douglas Campbell moved to pay bills with a second by Duane Jenkins.  Roll call all yes.

Fiscal Officer Report

Fiscal Officer Susan Denbow presented the February bank reconcilement for review.  The trustees approved and signed the reconcilement.

Fiscal Officer Denbow presented the February monthly reports and gave copies to each trustee.  The trustees signed that they had received their copies.

Fiscal Officer Denbow requested approval of the permanent appropriations that the trustees had been given.  Mark Hickey moved to accept the permanent appropriations with a second by Douglas Campbell.  Roll call all yes.

Fiscal Officer Denbow presented mileage reimbursements for Mike Trull and Steve Denbow for taking 2711 to Twinsburg for repairs.  She stated that neither had received their termination letter.  Douglas Campbell asked if all fire department equipment had been returned and Duane Jenkins informed him that it had been returned.  Douglas Campbell moved to reimburse the mileage with a second by Mark Hickey.  Roll call all yes.
Fiscal Officer Denbow stated that she had received a mowing bid and was unaware that a notice for bids had been placed.  Douglas Campbell stated that he had also received a bid and stated that a notice had not been placed.  Mark Hickey will write a bid notice to be approved at the next meeting.  The fiscal officer reminded him to add the mowing of the ball field to the notice.  The bids received will be held and considered or the bidders can resubmit a bid to include the ball field.

Fiscal Officer Denbow read a notice from Ohio Billing about a “Pieces of Ohio” quilt made from T-shirts sent by Ohio fire departments.  It was given to the fire chief to consider.

Fiscal Officer Denbow informed Gary Hollingsworth of a burial on Thursday at 11:00AM for retired Ruggles-Troy Fire Chief Robert Cole.

Fiscal Officer Denbow stated that she had received a post office notice that they had a letter addressed to Trustee Duane Jenkins that had been left on the counter.  Duane was given the notice so that he can pick it up.

Douglas Campbell inquired about the re-keying of the PO box.  The fiscal officer stated that she had been informed by the postmaster that their records indicated only one key had been issued for PO box 9.  Doug stated that he knew there was a second key and that the box should be re-keyed.  The fiscal officer will arrange this.

Douglas Campbell stated that a special meeting had been set for April 1 to transfer and inventory the fiscal officer’s records and equipment.  Fiscal Officer Denbow asked why it was not being picked up at her house as it has been done in the past.  She was informed that it had been requested by incoming fiscal officer Donna Riley and was the legal way to do it.  She stated that she would not load and unload all of the equipment.  Peggy Skinner and Cindy Benner offered to pick everything up on a trailer and bring it to a meeting for inventory.  They will then take it to Donna Riley.  Douglas Campbell moved to set the meeting for March 30 at 6:00PM with a second by Mark Hickey.  Roll call all yes.

Douglas Campbell arranged to meet Donna Riley on April 5 at Chase Bank to add her to the bank accounts.

Douglas Campbell stated that John Goodall from the Ohio Department of Taxation had contacted the township about the use of off road diesel.  He had requested copies of the last four years fuel receipts and fuel logs.  Duane Jenkins stated that he had contacted Mr. Goodall about the request and was told that the Carl Riehart of the Sheriff’s Office had initiated the investigation of the use of off road diesel.  Duane then contacted the SO and requested a copy of the SO report and was told that there was no official report, only complaints that had been phoned in.  Duane stated that Mr. Riehart told him that the calls had come from Mike Trull, Steve Denbow and Tony Leonetti.  Mr. Goodall stated that the township would owe road taxes on fuel that was used for on road vehicles.  Duane stated that he would deliver the copies to Mr. Goodall.  The fiscal officer gave a set of copies to Doug and to Duane.

Douglas Campbell stated that he had called OTARMA about the renewal form and they had faxed him a copy.  He stated that he did remember receiving the questionnaire but did not have all of the information that needed to be filled in.  He requested a copy of last years renewal form and stated that he would contact OTARMA about more time to complete the form.

Douglas Campbell stated that the fiscal officer had given him the customer authorization forms from Nova Telephone.  He stated that each trustee and the fiscal officer should fill one out so that they can access the accounts at any time.

Road Supervisor Report

Gary Hollingsworth stated that they had found a Troybilt rototiller for $650 at Home Hardware that they would like to purchase for use in the cemetery.  Douglas Campbell moved to make the purchase with a second by Duane Jenkins.  Roll call all yes.

Mark Hickey asked if Gary had tended the hole at the cemetery.  Gary stated that he had filled the hole with dirt but it had sunk in again.  Mark suggested using limestone in the bottom of the hole as a fill.  Gary will check to see if he can determine the cause first.

Gary made a request to purchase 100 ton of stone.  Douglas Campbell moved to approve the purchase with a second by Duane Jenkins.  Roll call all yes.

Gary requested to purchase 4 loads of cold patch for the roads.  Douglas Campbell moved to make the purchase with a second by Duane Jenkins.  Roll call all yes.

Gary stated that he would like to rent an excavator for the funeral on Thursday.  Mark Hickey made a motion to rent the machine with a second by Duane Jenkins.  Roll call all yes.

Douglas Campbell thanked Gary and Paul for their work during the recent snowstorm.  With help from the trustees, they were able to keep the roads open.

Zoning Inspector Report

Janice Steele turned in a voided permit for Aaron Miller as his variance had been denied.

Janice asked if the contracts for Clean Up Day had been signed and faxed back to Genesis and Brown’s Trash Removal.  The fiscal officer stated that she had not been informed that they needed to be faxed back.  She will get with Janice and take care of it.

Janice reported that she was checking the Gingerich property and that no building was being done yet.  She reported that Bill Wright was putting up a storage barn and when she contacted him, he was not aware that he needed a permit for an agricultural building.  He has made arrangements to get the permit.

Janice stated that e-mails are public record and she will mail Duane copies of her reports.  Douglas Campbell requested that reports be mailed to him also.

Janice stated that the variance for Aaron Miller had been denied.  Douglas Campbell made a motion to return Mr. Miller’s fee for the variance request.  He stated that he feels Trustee Mark Hickey is in violation of township zoning resolutions and that they cannot legally enforce zoning because of this.  Duane Jenkins seconded the motion.  Roll call Campbell and Jenkins yes, Hickey abstained.

Douglas Campbell made a motion for Janice to start legal proceedings against Trustee Hickey for the zoning violations.  Duane Jenkins seconded the motion.  Roll call Campbell and Jenkins yes, Hickey abstained.

Fire and EMS Report

Chief Jeff Shelton requested to purchase turnout gear for himself as no department gear fits him.  Mark Hickey moved to purchase with a second by Duane Jenkins.  Roll call all yes.

Chief Shelton advised that he had received grant paperwork from FEMA.  Grants are being offered to volunteer departments for pumpers/tankers, vehicle radios, etc.  Department members and township employees need to get NIMS certification to apply for these grants.  Cindy Benner offered to set up a class to work with anyone online to get this done.  The website is FEMA.gov.

Assistant Chief Les Handley turned in a receipt for the PO box payment and an invoice for the EMT class being attended.

AC Handley reported that the estimate on the CAFS unit for 2711 was $35,000 and repairs to the foam pump would be $12,000.  He is working on a grant for $10,000 to be used for turnout gear, pumps, hoses, nozzles, training, etc.  He needs the paperwork from the Fire Indemnity Board to be sent in to apply for this grant.  The board consists of Trustees Douglas Campbell and Duane Jenkins, fire department members Phyllis Bauer and Gary Hollingsworth and resident Jerry Sayles.  Douglas Campbell moved to set a meeting on Friday, March 21 at 7:00PM with a second by Duane Jenkins.  Roll call all yes.

Chief Shelton reported that he is setting up combined trainings with surrounding departments.

Douglas Campbell stated that Jeff and Cindy had been hired as township employees and needed paperwork filled out for PERS.  Jeff Shelton stated that as a volunteer fire department, they did not have to join PERS.
Douglas Campbell presented proposed EMS billing fee increases from Ohio Billing.  Duane Jenkins moved to accept the fee schedule with a second by Mark Hickey.  Roll call all yes.

Douglas Campbell stated that RLCWA was having a public auction in May and the township could put anything in to be auctioned.  He stated that if the township was looking to get new equipment, then they needed to make some room.  Duane Jenkins moved to send 2713 to the auction with a second by Douglas Campbell.  Roll call all yes.

Gary stated that the yellow dump was not being used much due to its condition.  Mark Hickey stated that it was a good truck to use for dust bond applications.  Douglas Campbell moved to send the yellow dump truck to the auction with a second by Duane Jenkins.  Roll call Campbell and Jenkins yes, Hickey no.

The trustees stated that Gary should make a list of any items he felt should go to the auction and bring it to the next meeting.

EMS Chief Cindy Benner stated that she needed a tax exempt form to complete paperwork for grant money.

Chief Benner requested reimbursement for postage, envelopes, and ink cartridges.  Douglas Campbell moved to reimburse the expenses with a second by Duane Jenkins.  Roll call all yes.

Chief Benner advised that she was working on grants from the State of Ohio and a $2400 grant from LMRE for chairs and tables for the training room.

Trustee Reports

Duane Jenkins stated that he had prepared a draft for the newsletter and read it aloud.  Douglas Campbell stated that he will prepare the newsletter.  Mark Hickey stated that he thought each trustee would submit a letter as had been done in the past.  Duane stated that they had agreed to writing one summary from the trustees. 

Mark Hickey turned in the American Red Cross paperwork for the emergency shelter.  They have inspected the building and checked the inventory of cots, blankets, etc.

Mark Hickey turned in a record of his time spent working on the roads during the recent snowstorm.

Mark Hickey stated that he planned on attending a meeting on CDBG grants with the commissioners.  He would like to pursue grant money to improve the sidewalks in town.

Mark Hickey stated that he is working on the door to the training room.

Mark Hickey reported that he had contacted D&D Emulsions about dust bond prices.  The total spent last year was $14,000 and included the storage tank.  The price last year was $1.87/gal and would be good until April 30.  It would then be $2.00/gal until they set the new price for 2008.

Mark Hickey stated that he had not seen the chip and seal bid in the paper.  Douglas Campbell stated that because Mark had met with Ed Meixner, he had been told that they needed to decide what they were doing.  Mark stated that he had only asked Mr. Meixner for his opinion and that the bid notice could be placed at any time.

Mark Hickey made a request for copies of zoning records and meeting minutes from May 2002 thru September 2002.

Open to the Floor

AJ Signh made a request of the township to purchase refurbished pumps.  The cost would be about $2500 for just the computers, $3300-$3500 for refurbished pumps, and $10,000 for new pumps.  He stated that the existing pumps do not allow them to set prices above $4.00/gal and that diesel fuel prices are more than this so they are losing money.  Douglas Campbell stated that he will have to check the contract to see what the township is responsible for.  AJ asked if some of the holes that have opened up in the parking lot could be fixed.

Carol Stasick asked if the Ladies Auxiliary could write a letter to be placed in the newsletter and was told that they could.

Rich Johnson asked if Gary had checked the hydrant and Gary stated that he had.  Rich stated that the guys had done a good job during the snowstorm.

Donna Riley stated that Barb Herrick had contacted her about the township purchasing 288 cemetery flags for Memorial Day.  The cost was $254 last year.  Mark Hickey moved to purchase the flags with a second by Duane Jenkins.  Roll call all yes.

Donna gave each trustee their copy of the Township Resource Book she had ordered. 

Faye Schwab asked if the roads would be prepared prior to the chip and seal being done.  Douglas Campbell stated that they would be repaired and prepared.

Ron Blessing stated that the roads had been plowed during the snowstorm but large piles were left along the edges of the road and at intersections.  This made it difficult to see when pulling onto the road or into intersections.

John Storch asked Duane Jenkins if he had checked with other townships that had posted speed limits on their township roads.  Duane stated that he had not checked.  Mr. Storch stated that Milton Township had posted speed limits on a little more than a mile of their roads.  He stated that studies showed that the speed limits had little or no effect and that ODOT studies also showed little effect.

Peggy Skinner turned in the original copy of the minutes she had written for the March 3 meeting along with the floppy disc.

Peggy stated that attendees of the March 28 zoning workshop would need reimbursed as they had sent in their own payments to secure their places.

Peggy stated that a group of residents would like to start the Deb Cowen Auxiliary for the elderly and disabled.  Douglas Campbell stated that the trustees did not have any involvement with this.  Peggy stated that they would like to use the community room and kitchen for fundraisers, meetings, etc.  Mark Hickey stated that he did not think they could use the fire department kitchen.  Doug stated that if they made them a township auxiliary, then they could use any township building.  It will be checked into.

Les Handley stated that he needed a copy of the annual budget for the fire department for the grants.

Mark Hickey moved to adjourn the meeting at 9:20 with a second by Douglas Campbell.  Roll call all yes.
