Regular Business Meeting
May 5, 2008

The meeting was called to order by Campbell at 7:00 PM. Followed by the Pledge of Allegiance.

Meeting is being taped for benefit of the Township.

Campbell moved approve the minutes from April 21, 2008 Second by Jenkins. Roll call all yes.

Hickey requested the following information be added to the minutes. Hickey was not present at the township meeting April 21, 2008. He attended a meeting on the Pipe Line.

Campbell asks if there were any checks out of the ordinary. There was one. A check for the Ohio Department of Taxation in the amount of $1,358.00. Campbell explained that the check was for back taxes for buying red fuel. He explained that the township was not penalized, because the problem was corrected and the township now buys on toad fuel. Jenkins moved to pay the bills. Hickey second. Roll call all yes.

Hickey refused to sign the checks for Chief Shelton and Chief Benner. Hickey said they do not have a job description policy and he feels they should not get paid until they do.

Campbell moved to purchase a snow plow for the Grass Buggy form Savannah Motors for $1500. Jenkins second Roll call Campbell-yes Jenkins-yes Hickey-no

Campbell moved to re-schedule the trustees meeting to Tuesdays May 20, 2008 June 3and June 17. Jenkins. Second Roll call all yes.

Fiscal Officer’s Report

Bank Reconciliation Statements was reviewed and signed by the trustees
Received a Thank You and the Title from Harrison Ford on the 2001 Chevy Blazer
Turned in a letter from the Department of Transportation
Turned in a letter from OPERS, Rep. will be the area soon
Turned in a bill from Nortrax for Grader repairs that did not solve the problem
Turned in a letter for Underground Storage Tanks
Turned in a letter from ADS open house Appreciation Day with times and date
Turned in a citizen’s complaint from Chris Overstreet about mowing the park
Ask for Glass Block to be installed in the Records Room Window
Ask about Vehicle inspection sheets for Town ship Equipment
Turned in three letters one was $5.00 donation to the Fire Department
One was Ms Harper regarding the speed limit on township roads
One was from the Ashland County Prosecuting Attorney’s Office on Vandalism
Turned in copies of appeals for variances from Janice Steele
Tape recorder and tapes given to Chief Shelton
Turned over all documents requested by Mark Hickey, except for two Audio Tapes

Fire Report

Chief Shelton presented an application for a new member Steve Shinsky to join the Fire Department.
Hickey moved to accept Steve as a probationary member. Jenkins second. Roll call all yes.
Spencer has a class scheduled that he can attend.
The Fire Truck that was donated by Avon Fire Department will be serviced at Williams. They will give an estimate on six gages that needs to be repaired. This vehicle will be a back up Pumper.

EMS Report

Chief Benner turned in invoices for mileage for NIMS training for Phyllis, Gary and Cindy.
Benner informed all about the NIMS training coming in May.
Benner turned in information on the Stryker Chair.

Jenkins talked with the Prosecution Attorney about the Fire and EMS Levies to have them on the Ballot this November. He will get tentative dates to meet with them.

Road Report

Gary requested that L.M.R.E. install a light by the Fire Station. Cost $11.00 per month. Jenkins moved to have the light installed. Second by Hickey. Roll call all yes L.M.R.E. needs a setter from the Board of Trustees. Jenkins will write the letter.

Campbell moved to purchase four 4x6 Flags at $38.00 each and four 5x8 at $50.00 each for Memorial Day. Jenkins second. Roll call all yes.

Campbell moved to buy dust bond approximately 1900 gallons to the tank. Jenkins second. Roll call all yes.

Gary stated that the floor in the Red dump truck needs to repair. He had a quote from AmTec for two pieces of steel. The cost $378.96 Trustees advised Gary to get more quotes.

Gary asks for a tree to be removed form the Cemetery before it falls and damages headstones. The quote from Justin tree Removal was $1,175. Hickey advised he will get quotes for tree and stump removal.

Trustees Report

Hickey advised Gary to at road surface on Twp Rd 150 and Co Rd 281. Also look at Mr. Hopper’s culvert at 426 Twp Rd 581. The stone has washed off the road into the ditch.

Jenkins advised Gary to look at Twp Td 462 for ditching.

Campbell advised that 224 from State Rt. 58 301 will be closed for culvert repair from May 7, 2008 to May 23, 2008. On June 1 the State will be resurfacing 224.

Trustees will check on purchasing grindings from the State.

Campbell tanked Eric Bartok and John Kenny for helping on clean up day.

Hickey stated there were 451 tires collected. They will leave the trailer for an extra week. Anyone who still has tires should get in touch with him and he will contact Janice for a receipt.

Zoning Report

Janice turned in $354.00 for tires and a receipt book. She requested a ream of paper, stamps, and plastic covers. She turned in forms from the Prosecutor’s Office. A stop work order, Notices of Appeals of Alleged Errors by the Zoning Inspector. Hickey made a resolution to adopt the forms as policies. Campbell second. Roll call Hickey-yes Campbell-yes Jenkins-yes.

Janice advised the trustees about the speed limit. It was put on the site so residents could express their feeling on the speed issue. There was problem in posting it on the web, but it is now up and going.

Jenkins questioned Janice on zoning violation letters. She stated that Bartok’s had done a lot of cleaning up. She said that Mr. Cull called, and he wanted a permit for a barn. She said, there was no response from the gentleman on Co. Rd. 681 for a storage building.

The Amish on St. Rt. 58 will get back with her about the violation. She sent a second letter to them.

She stated that she sent a second letter Mark Hickey and there was no response. Hickey contacted her concerning an appeal that is what prompted the form on the Zoning Inspector Error.

Campbell questioned Janice about the zoning. He informed her that she was to follow the Zoning Book. He also stated that the trustees cannot instruct her on how to proceed with the zoning. This conversation was prompted because of an earlier statement made by Steele. In a prior meeting Steele stated that she was waiting for the trustees to tell her what to do in zoning. Jenkins moved to remove Janice Steele from the position of Zoning Inspector. Campbell second. Roll call. Jenkins-yes  Campbell-yes  Hickey-no.

Jenkins asks David Spieker if he would be the interim Zoning Inspector. He accepted. Jenkins moved to put Spieker on as the interim Zoning Inspector. Second by Campbell Roll call Jenkins-yes Campbell-yes Hickey-no. Fiscal Officer will get Spieker Bonded.

A.J turned in May rent check $1000. He stated that he is still working on the quote for the Gas Pumps

Campbell announced that the Auction at R.L.C.W.A. will be held on May 17 or 18. He stated that the equipment needs to be ready for the Auction.

Hickey turned in his NIMS 100 certificates. One to the Chief and one to the Fiscal Officer.

Hickey requested to be reimbursed for his time and mileage for reporting to the Aims Clinic for Drug Testing. He questioned the Fiscal Officer about who was on the drug list. She stated Gary, Paul, and Mark because they all hold a CDL license with OTARMA. Campbell asks Gary and Paul if they charged for mileage when they went for testing. They both said no.

Hickey made a public request for a copy of the Drug Policy that requires Drug testing> they will check with the Prosecutor’s Office to make sure that the Drug Policy is public record.

Open to the floor

Brian Swiger stated he has made his fifth request on John Temple concerning the access driveway. In an email on Feb 21, 2008. Janice stated there was no written complaint. She stated that the driveway issue had nothing to do with zoning. She stated that she believes the driveway issue is civil matter. Mr. Swiger stated that he had questioned the trustees about an article in the Times Gazette on April 25, 2008. Janice stated that all the statements came from Hickey’s letter.

Mr. Swiger’s fifth request, He asks why the job policy for the Zoning Inspector was not signed. Trustees stated that she was not required to the policy. They stated that the policy was given to the Zoning Inspector in a township meeting.

Mr. Swiger’s first request, Feb. 21, 2008 He requested a signed copy of the job description for Zoning Inspector.

Mr. Swiger’s fifth request, He requested copies of Audio Tapes of the trustees meeting from 2006.

Mr. Swiger’s sixth request, He requested the termination and discipline records of Janice Steele. He wanted to know how many times she had been disciplined. He also wanted to know why she was terminated. Trustees stated there was no discipline action taken and the reason they removed Ms. Steele was because they wanted to move in different direction.

Mark Schwab requested March 17, 2008 trustee minutes. And Feb. 22, 2008 Transcript of the Public Hearing on the Zoning Map, and Trustee Meeting.

Pat Dawson asks how long David Spieker will be zoning Inspector. She asks if the position will be posted in the paper. She said that she hopes the trustees will keep everything on the up and up.

Campbell moved to post the opening for the zoning Inspector in the paper. Jenkins second. Roll call all yes. The application will open on June 17, 2008 at the trustees meeting.

Susan Denbow asks about a key to the Fire Station so the Ladies Aux. could have access to the kitchen for upcoming events and cleaning supplies. Hickey asks Mrs. Denbow if she would attend the Fire Meeting on Wed. to discuss this issue. She stated yes.

Trustees signed two checks, one for Savannah Motors for the Snow Plow and one for the Holiday Inn for classes for Gary and Paul in Marietta Ohio.

Cindy turned in an Estimate for P.C. Landscaping to clean up trash around the township.
