Regular Business Meeting
June 17. 2008

The meeting was called to order by Campbell at 7:00 p.m. Followed by The Pledge of Allegiance.

Campbell stated the meeting is being taped for the benefit of the township.

Campbell asked that all cell phones be kept quite.

Hickey moved to approve June 3, 2008 minutes. Campbell second. Roll call all yes.

Campbell moved to pay the bills. Jenkins second. Roll call all yes.

Hickey questioned Judy Kocab’s check. He stated that he voted no at a previous meeting because there was to be no charge for training classes. She was to submit a bill first and then the trustees would approve It. Trustees had a brief discussion on this issue. Hickey did not sign the check.

Chief Shelton informed the trustees that Judy Kocab is on the Department now and she would not be charging for training.

Hickey questioned Accurate Mechanical Services. They installed the furnace and air conditioning in the records room. He wanted to know if they had a permit to run a business in the township. Jenkins stated that are incorporated and they provided the township with all the paper documents that was required. Hickey did not sign the check.
Campbell moved to pay James Wolfe for the installation of the electrical panel of $490.00 and the installation of the furnace and air conditioning of $4,886.00 Jenkins second. Roll call all yes.

Fire Chief Report

Chief Shelton stated that the Fire Department received a grant for $8000.00 from the Fire Marshall’s Office. The grant will help pay for the pump repair on 2711. Rick from Findley Fire will stand by the quote from last year of $12,321.00. He informed the trustees that there would be a 3 weeks delivery time and it would take two and half days to repair the pump. The Chief will notify the neighboring townships when the Fire Truck goes in for service.

Fiscal Officer informed the chief that they received a grant from the Fire Marshall’s Office for $1650.00. The grant will be used to pay for the firefighters that are attending training classes.

Chief Shelton informed the trustees that in last few months they have received $17,600.00 in grant money.

Campbell moved to advance $5000.00 from the general Fund to the Fire Fund. The money will be used for the repair of the foam pump on the fire truck.
The $5000 will be returned to the general fund in August when the seconded half money comes in. Advance Ref #06/17/08 Hickey second Roll call all yes.

Campbell moved to have the chief get the repair done, Jenkins second. Roll call all yes.

Chief Shelton talked with Chief Walker from Wellington Fire Dept. he donated 3200 pairs of gloves to Sullivan Fire Department. 

Chief Shelton turned in a bill from Freelance on the lettering for the new Grass Buggy for $275.00. He will get with Gary to get everything switch over to the new Grass Buggy.

Chief Shelton and the Trustees had a brief discussion about a State Bid. They want to purchase a Squad. They will get $5,300.00 off the list price. The earliest arrival date would be the second week of September.

Jenkins stated that Comstock should be getting back to him within a week about the purchase of a squad.

Chief Shelton stated that all members coming on the Department would be required to sign a two year agreement.

Chief Shelton and the Trustees had a brief discussion about Gary responding to emergencies calls while he is working for the township. Trustees will contact Comstock about this issue.

Chief turned in the SOP’s to the Fiscal Officer to make copies for the Trustees to review.

EMS Report

Chief Benner informed the Trustees that the pulse-ox has been repaired. Cost $200.00. The censor had to be replaced.

Chief Benner announced that a nurse form Samaritan Hospital joined the Dept as an EMT Cindy Downs. Campbell moved to put Cindy back on the Dept. Jenkins second Roll call all yes.

Chief Benner announced that the Dept. has received a lot of grants and they expect more to come in soon.

Letter from Prosecutors Office on the Vandalism case

Sue Denbow received her copies of the case

Turned in Grant letter form the Fire Marshall Office for $1650.00 for training

Requested Zoning Inspector Legal Opinion form to be changed

Turned in form from L.M.R.E to be filled out, $100.00 credit for a timer on the air condition, $6.00 credit in the 3rd year. June, July, and August will be the peak hours.

Turned in OTAMRA Survey

I informed the trustees about Budget Hearing. Campbell moved to set the date for July 7, 2008 Jenkins second. Roll call all yes.

Turned in letter from Ashland Solid Waste

Gave Steve Dembow’s records request to Sue Denbow. Cost $15.00 for two tapes and one CD

I Had Paulette Swiger’s records request at the township meeting. I informed the trustees of the cost. The list included, Trustee Minutes of 1993, 1994,1995,1996 , 2000, 2001, 2002 2003,2004 total pages 844.Cost $84.40.

 Also included in her request was, 2002 Zoning Commission Minutes total pages 29 cost $2.90

Zoning Permit for Storage Building total pages four. Cost forty cents. One CD Cost $1.00.
Five tape recordings of the minutes from the Zoning Board of Commissions. Dates requested, two tapes of 3/13/06. Two tapes of 3/27/08 and one tape of 3/10/08. Cost $35.00. She was not present to receive her records request.

I will send a certified letter of the bill to Paulette for the cost of records. $123.70

Campbell showed the public 9 pages of request plus 6 more pages the Fiscal Officer received that day.

A certified map is in the records room. The map hanging in the Community Room is a certified copy that has been time stamped from the Recorders Office.

There was a brief discussion about the map that used be on the wall. Hickey questioned why the map that was on the wall for a short time was taken down. Campbell explained he took it down because the copy had not been recorded by the county recorders office and felt we should wait until it had been recorded. It is back up now because it has been officially recorded by the fiscal officer. Hickey then questioned asking if Campbell had removed the map because of a fear the map would be challenged in court. Campbell stated the map was not on the wall when he became a trustee at the beginning of the year. The previous trustees had removed the original map because Campbell remembered the map hanging on the wall during his previous term as trustee. The map had been placed on the wall this year strictly as reference map but Campbell felt that we should wait until it was recorded before placing it on the wall. It has now been recorded and is displayed on the wall

Power Plan gave Gary a contact name and number. Jenkins stated Gary is to talk with them and inform them that the grader has not been repaired. Jenkins stated If Gary cannot get this issue resolved by Friday, that he will take care of it.

Fiscal Officer will get the work order on the grader and make copies for the trustees.

Chip and Seal Bids

Henry W. Bergman, Inc, at $.23 per sq. yd to apply the materials
Smalls Asphalt Paving, Inc. at $.30 per sq. yd. to apply the materials
Lytle Construction., Inc. at $.22 per sq. yd. to apply the materials

Campbell moved to award the Chip and Seal Bid to Lytle Construction., Inc. Hickey second Roll call all yes.

Zoning Report

Spieker turned in the zoning report to the trustees.


He had a brief discussion about the shooting challenge permit. There was an issue about the time frame. The permit that was issued by Janice Steele said 6 months. Later the permit went to12 months and the minutes reflected 6 months. There was nothing in the minutes that said 6 or 12 months. The permit was for 6 months and there was no correction in any minutes.

Hickey stated that he was at that hearing and it was 12 months. Campbell stated they can’t question the appeals discussion. Jenkins stated to send a registered letter to the owners stating that their permit has expired. The trustees had a discussion about this issue. They stated that the Zoning Inspector needs to do his job.

Spieker spoke briefly about the saw mill on County Road 500.

A.J. turned in the paper work to the trustees on the Under Ground Storage Tanks. He stated it was their responsibility. Cost $200.00

Campbell moved to reimburse Janet Richards for her EMT Test and mileage for classes and clinicians. Hickey second Roll call all yes.

Campbell moved to go into executive session at 8:25 pm to interview the candidates that were present. Jenkins second Roll call Jenkins-yes Campbell-yes Hickey-yes.

Campbell moved to enter back into the Regular Trustee Meeting at 8:57 pm. Jenkins second. Roll call all yes.

Jenkins moved to hire David Spieker as the new Zoning Inspector. Campbell second Roll call Jenkins-yes Campbell-yes Hickey-no

Campbell addressed the property on County Road 281. The permit issued for that property, was for a Storage Building. The property was listed in the Trading Post as a home. The Zoning Inspector needs to look into this issue.

Spieker and the trustees had a brief discussion about a building on County Road 681. Trustees advised Spieker to look into it.

Road Report

Gary stated that he needed to purchase two culverts. Cost $240.00. The culverts will be used on Twp Rd 581 near the Harris Property. Campbell moved to purchase the culverts. Hickey second Roll call all yes

Township Road 581 will be closed Monday, June 23, and Tuesday the 24, between Twp Rd 150 and Co. Rd.40 for a culvert replacement.

Gary needs a P.O. for 500 tons of stone. Campbell moved to purchase the stone Jenkins second. Roll call all yes.

Gary stated that Township Roads 581 and 462, 350, and 150 should be ready for chip and seal by the 2nd week of July. Hickey asked Gary about Twp Rd. 391 he felt 391 needs to be repaired more than 150. Campbell stated he would like to get a grant for twp. Rd.391.

Trustee Report

Hickey addressed Gary and Paul’s time sheets. He would not sign them because he could not make heads or tails out of the sheets. Hickey stated that he would like to see a more detailed time sheet, so he can track their daily progress. The time sheets do not need to be two sided. Hickey wants one sided forms that can be tracked much easier. Fiscal Officer will make the copies.

There where complaints about the weeds on the side of roads. Hickey stated that Paul should start mowing on Tuesday.

Hickey questioned Gary about the copier in the garage. Gary stated he used it to copy the culvert permits.

Jenkins stated he will speak with Comstock about the Verizon Wireless.

Jenkins received a call from Ron Amstutz. He informed Jenkins that he had received complaints about the hog farm in Sullivan. He stated that the state will look into this issue.

Campbell stated that he talked to Mr. Zager about the post at the garage. He wants to know if the township could donate them. Hickey stated they should be used to repair the Salt Bend. The Salt Bend is broken and the Salt is going on the property behind the building. Campbell asked how many they would use. They would use 4 to 6 post. Campbell moved to donate the post to the Conservation Club. Jenkins second. Roll call, Campbell yes. Jenkins yes. Hickey no.

Open To Public

Richard Johnson discussed the roads. He stated that the berms are higher than the roads. He asked the trustees what their intent was for Twp. Rd.391 Trustees stated they would like to get something done with it.

Peggy Skinner asked if a sign could be posted on the door that stated. Please turn off Cell Phones. .
Mark Schwab stated that the shooting challenge permit was 12 months. He also asked the Fiscal Officer how much of his personal information has been given out. Fiscal Officer stated none has been released.

Sue Denbow requested a copy of the Public Records Policy.
She also asked about the vehicle damage sheet because of the damage to Fire Dept. Bay Door.

Jenkins stated that he damaged the door with the backhoe and it was discussed at a previous meeting when Hickey put the Township Dump Truck in the ditch during a snow storm.
She also asked about the roof on the Community Room. She wanted to know if it had been leaking because the ceiling panels are stained.

John Denbow questioned why the map wasn’t up for the public hearing. Campbell stated he took it down because it was not a certified map.
