Sullivan Township Trustee
Regular Business Meeting
July 7, 2008

Attendance:  Douglas Campbell Chairman

Meeting was called to order by Campbell at 7:00 PM. Followed by the Pledge of Allegiance.

Meeting is being taped for the benefit of the Township.

Hickey moved to approve the minutes with on correction. Campbell second Roll call all yes

Hickey moved to pay the bills. Campbell second Roll call all yes

Trustees reviewed and signed. The Bank Reconciliation and the Monthly Reports.

Hickey questioned the Safety Officer’s check asked if he has given any reports. Campbell stated he has

Campbell wanted the minutes to reflect Hickey didn’t sign Chief Shelton or Chief Benner’s checks because they had no Job Description. Campbell stated it’s in the SOP’s

Campbell announced Jenkins will be late for the meeting.

Open To the Floor

Ron Blessing questioned the Web Site. He also asked about the mowing on Twp. Rd. 462 the water isn’t going through the ditch. Hickey stated they need to get out and get the mowing done.

Mark Schwab asked about the signs for the Chicken BBQ on July 26, 2008 at Kno Ho Co. And about the drain tile under the road on Twp. Rd. 150 it’s blowing out and the ditch is caving in.

Sue Denbow asked about the property 168 Co. Rd. 281 the owners have not mowed their grass.

Peggy Skinner addressed the right away on Co. Rd.40 it needs to be fixed since it belongs to the Township so they can mow the Cemetery. The culvert was taken out and someone needs to contact L.M.R.E because of a live wire down. Hickey will get in touch with the gentleman who owns the property next to the Cemetery.

Zoning Report

Spieker turned in his report.

Spieker spoke about the property on Co. Rd. 281 and read a letter from the owner Chris Simoms.

Hickey will draw up a letter for a Legal Opinion to be sent to the Prosecutor’s Office about volunteers to clean up the property on Co. Rd. 281 because of safety issues.

Complaint on Co. Rd. 281 about the junk, they are going to put a fence around the things they are keeping. They did remove a junk vehicle.

The Property on Twp Rd 391 north of Co Rd 500 was construction going on. Spieker went to the owner and told him someone was going to get in touch with him, they never did. Spieker went to the owner and the owner stated that he didn’t need a permit. Spieker told him he would have to pay an application fee. Spieker told him he would have to write a violation letter and send it to him,

Campbell stated to comply with the Board of Election on Handicap Issues at the Community Room they would need to install Lever Handles and Van Accessible sign and Threshold ramps entering into the building.
Campbell moved to purchase the Lever Handles with 12 keys and the Van Accessible sign. Hickey second Roll call all yes. Gary and Paul will take care of this. Hickey stated they need to check with ADA on the specs for the ramp.

Road Report

Gary was not present he had to be with his mother

Keith Rowe asked about the door opener on the Fire Department bay doors. Hickey stated we need to have Curtis Door come down and check out the door opener and have him service it. And get the cost to replace the bay door panels.

Fire Chief Report

Turned in an invoice on Medical Supplies

Chief presented a letter to the Trustees about a member on the department who order medical equipment   under our Tax Id and Drug License in June and medical supplies was shipped to their house. He turned in the information to the Trustees to review and decide what to do about this at the next meeting

Chief Shelton questioned Hickey as to why he is not signing his check. Hickey stated that even though the SOP’s might state the detailed Job description of the Chief, he felt the auditor’s would bring findings against him for paying Shelton a payroll check without an additional township Job Description for the chief. Hickey stated it is nothing personal, but he did not want a finding from the auditor’s office in his name. Shelton questioned if Hickey would recognize him as Fire Chief at a fire scene. Hickey stated he would but added if Shelton would like, he will stay clear from all scenes.  Campbell questioned if the trustees had read the SOP’s presented by the Chief at a previous meeting. Jenkins stated yes and Hickey stated he had not had time to review them. Jenkins made a motion to adopt the SOP’s with a second from Campbell. Roll call Jenkins yes Campbell yes Hickey abstained. Jenkins stated that Ohio Revised code outlines the Job Description for the Chief. Hickey also questioned the First Responders vehicle use and the fact that there was no written policy in a Job Description about its usage. Campbell stated that should be handled by a vehicle policy description.

 Trustees had a brief discussion about the Township first responder vehicle the Chief drives.

Trustees had a discussion about an opening from the Community Room into the Kitchen for events to separate it from the Fire Department. Jenkins will get with Gary and set up a time for someone to take a look at it.

Trustees discussed financing a new squad, there’s two ways it can be done. They can check with OTA Leasing Program or they go with a bank or a Loan Company. Hickey asked Jenkins if he got in touch with Comstock on this issue. Jenkins stated Comstock was gone on to a convention. Trustees stated that any contracts with anyone must go through the Prosecutors Office first.

Campbell moved to purchase the Squad presented by Life Line. It will be purchased through PFUND Superior Sales at State Bid. The cost, $144,567.00 Jenkins second .Hickey stated, pending approval of the Prosecutors Office. Roll call all yes. A letter will be drafted and sent to all parties involved.

The new Grass Buggy 2745 is now in service the Grass Buggy 2744 is now being used by the road crew.

EMS Report

Chief Benner presented the Trustees with an application from Karen Borges, she would like to join the department as an EMT. She’s a LPN nurse and she is going to classes to be an RN.

Campbell moved to accept her on the department Jenkins second Roll call all yes.

Chief Benner informed the Trustees about a grant for $5,500 they will be receiving for training and equipment. To date, the department has received $26,000 in grant money.

Trustees Report

Jenkins spoke about having the property behind the KNO HO CO School in Sullivan surveyed for a baseball or soccer field for the kids. Campbell moved to have the property surveyed not exceed $1,500.00 Hickey second Roll call all yes. Jenkins will contact some Surveying Companies and have them send quotes to the Township P.O. Box 9.

Jenkins stated that the Ethics Commission contacted him and they need minutes from the start of his and Hickey’s term. January 1, 2006 to present they need to be sent to Molly Burins who in an Investigating Attorney. Jenkins talked to her about the charge for copies she stated it’s an investigation and they don’t pay for copies.

Hickey turned in an envelope from Janice Steele. She believes it might be about zoning but it was not opened. It was from an engineer.

Campbell stated they have had enough research on Speed Limit signs. Campbell moved to set the Speed Limit at 45mph on the following Township Roads 150, 350, 462, 581, 391. And post the 25mph on the following Township Roads 232, 212, 481, 501. Jenkins second Roll call all yes.

Fiscal Officer Report

Power Plan, Ed and Gary have been in contact with each other he would like to clear up the issue with the Grader.

AJ couldn’t attend the meeting he turned in July rent payment 1,000 to the Fiscal Officer before the meeting.

A Trustee needed to sign Gary and Paul’s time sheets. Campbell signed them. Hickey stated he would not because Paul refuses to fill his time sheets out properly. Gary is filling his out the way Hickey asked them to do.

Fiscal Officer turned in a copy of her NIMS 100 and 700 certificates to Chief Shelton

Fiscal Officer asked the Trustees who is going to over see the Road Crew now since Hickey is no longer in charge of them. Campbell stated he will take the position back.

Turned in a copy of a Legal Opinion Request Form for the Zoning Inspector for the Trustees to view

Trustees reviewed the Public Records Policy that was adopted showing the time set for records inspection. Thursday’s at 10:00 AM – 2:00 PM weekly. Call Fiscal Officer at (419) 736-3234. A prior notice of three days is required to schedule a records inspection.

Fiscal Officer needs Gary and Paul to move the filing cabinets out of the recycle building into the Records Room.

I asked the Trustees if they reviewed the agreement for the Collection Agency for Ohio Billing. They asked the Fiscal Officer to send it to the Prosecutors Office. They want them to review it before they sign the contract.

Carol Stasick from The Zoning Board of Appeals wants copies of the Transcript on the Public Hearing on June 5, 2008 and June 20, 2008.  Hickey received his copies. Hickey requested copies of the photos from the Hearing the Appeals Board had. Fiscal Officer stated she would have them sent out to be copied, because she can’t make color copies.

Jenkins stated he would like to make it a policy of the Township to hire a deputy to be at all the Appeals Hearings paid by the Township. Jenkins moved to hire the deputy.  Campbell second Roll call all yes

Campbell moved to go into Executive Session at 8:45 PM for Fire Issues. Trustees review a letter form Chief Shelton about medical supplies that was sent to someone’s home using the Township Tax Id. Trustees also reviewed the Law Suit with Bryan and Paulette Swiger. Hickey asked Chief Shelton and Chief Benner to join them Jenkins second Roll call Campbell yes Jenkins yes Hickey yes.

Campbell moved to enter back into the Regular Business Meeting at 9:27 PM. Hickey second. Roll call Campbell yes Jenkins yes Hickey yes

No decision was made pending an investigation

Spieker asked if he could proceed with the Hickey violation. A letter needs to be written. Jenkins moved for Spieker to move forward on the Hickey violation. And enforce the Zoning. Campbell second. Roll call. Jenkins yes Campbell yes Hickey abstained.

Campbell moved to adjourn the meeting at 9:30 PM. Jenkins second. Roll call. Campbell yes Jenkins yes Hickey no.
