Sullivan Township Trustee Attendance: Douglas Campbell Chairman Meeting was called to order by Campbell at 7:00PM followed by the Pledge of Allegiance. Meeting is being taped for the benefit of the township. Campbell announced Duane Jenkins will not be at the meeting because he had emergency surgery. Hickey moved to approve July 7, 2008 minutes with the corrections. Campbell second Roll call all yes Hickey moved to approve the Budget Hearing minutes. Campbell second Roll call all yes. Hickey asked about the gas station and the purchase of the new Gas Pumps. The township will not receive rent. The rent payment will be used to pay for the pumps until they are paid off. Fiscal Officer advised him that the Auditor has been informed and we will discuses this at the Budget Hearing on August 4, 2008 along with the grants and the Fire and EMS Levies. Campbell moved to pay the bills. Hickey second. Roll call all yes. Campbell moved to have the Trustees Meeting on August 4, 2008 changed to 7:30PM instead 7:00 PM due to the Budget Hearing with the Auditor. Fiscal Officer will post this in the paper. Hickey second Roll call all yes Fiscal Officer Report Gary and Paul’s time sheets were signed by Campbell. A copy of the returned receipt from the Ethics Commission Board was give to Hickey. Hickey asked the Fiscal Officer about the 2006 Trustee Minutes that was sent to the Ethic Commission Board. Fiscal Officer will have them at the next meeting. Hickey stated they might not be the same as the ones that he has due to corrections and he wanted to be on the same page as they are. A Legal Opinion Form for the Zoning Inspector was faxed by Hickey to the Fiscal Officer. The faxed copy was not readable. Hickey presented the Fiscal Officer with a clear copy. Copies of the Conditional Use Forms for Public Hearing were given to Carol Stasisk. Gave David Spieker and address sign. August 1, 2008 The American Red Cross will be having a Blood Bank Drive at the Community Room in Sullivan Township from 2:00 PM to 7:00 PM. The Appeals Hearing is the same night at 8:00 PM. The Appeal Board has been informed just in case the Blood Drive needs more time. Gary had 12 keys made for the new lock on the Community Room. Fiscal Officer gave a key to Peggy Skinner, Bud Jantz, Jerry Sayles, Carol Stasisk, Gary, Paul, Hickey, and Campbell. Jenkins will receive his at the next meeting. Fiscal Officer requested all old keys be turned in at the next meeting. Fiscal Officer presented the trustees with a Zoning Book that had been recorded at the Ashland County Recorders Office. The book will be placed in the records room along with the map. Campbell read Job Description Policy for the Fire Chief. Hickey stated they would have to expand the Fire Chief’s Job description to compensate for days off. Campbell stated that was specified when they hired him and he don’t think that should be in the Job Description. Campbell stated the form states what his job description is. Campbell made a resolution to adopt the form on July 21, 2008. Hickey second Roll call Campbell yes Hickey yes. Hickey was concerned about 2701 that the Chief drives. Campbell stated OTARMA covers it. Campbell moved to adopt by resolution of the Job Description for the EMS Chief. Hickey second. Roll call Campbell yes Hickey yes. Campbell moved to adopt by resolution Sullivan Township Driving Policy Hickey second Roll call Campbell yes Hickey yes Open to the Public Peggy Skinner questioned the right away on Co. Rd.40 to the Cemetery that the township owns. Hickey stated he talked to the gentleman and he will put the culvert in when he gets the money. Hickey also advised him to talk to the County Engineer. But until it’s fixed he advised Peggy to go and mow the grass, but go in on the west side of the building to get to the cemetery. Ms. Benner stated that if she gets "hit" backing out you’ll be responsible. Hickey will follow up on this matter. Richard Johnson Safety Officer reported there’s a couple of lights out south of town. Hickey advised Gary to contact the State. Johnson also reported on Twp. Rd. 391 by the Tarp Shop. The road is washing away into the ditch, and on Twp. Rd. 150 to Co. Rd. 40 the breams are bad. Johnson question Hickey about the $20.00 he gets paid a month for driving the Township. He stated that he spends more in gas than he gets paid, but that’s not the issue. He just wants the Trustees to know that he is doing his job. Someone said the Johnson was not turning in reports to the township. He told Hickey that if he had any questions just come and ask him. Carol Stasisk informed the Board that there is an Appeals Hearing August 1, 2008 at 8:00. She also asked the trustees if it was necessary to have a deputy at all their meetings. Campbell stated they made a resolution it’s mandatory for the deputy to be there. Campbell made a motion to resend his motion from the last meeting to have the deputy at the Appeals Meetings. Hickey second Roll call all yes. Campbell stated he will leave it up to the Appeals Board discretion. If they need the deputy at a meeting they will make that decision. Sue Dembow asked about a key to clean the Community Room. Campbell gave his key to David Spieker and Hickey gave his key Sue. Jerry Bauer stated the chairs that are now in the Community Room came from the Training Room. They where donated to the Fire Department by the post in Ashland and that he and Phyllis picked them up and signed for them. Fire Chief Report Chief Shelton announced that 5 Firefighters have pasted their training classes. Chief turned a check for $1,000.00 donated from the American Legion Post 8 in Wellington for a Laptop and Projector. Campbell questioned the Chief about the foam pump. Chief Shelton stated it has been ordered. When the Fire Truck goes down to be repaired it will be out service for 2 ½ days and he will notify Troy Ruggles, Spencer and Polk for mutual aid. Campbell stated once we get the new squad they will take 2736 and make it a heavy rescue squad. And take 2735 and have it refitted with a new box. Campbell asked the Chief to get a quote to have 2735 fitted. EMS Report Chief Benner presented a check for $200.00 donation from the American Legion in Ashland that can go toward the Laptop and Projector. Road Report Campbell asked Gary about the previous bill with Nortrex of $1087.00 Gary stated that it has been resolved and they wrote if off. Gray informed the Trustees that the value on the Grader needs to be repaired. He stated that he received the invoice from the Fiscal Officer right before the meeting and he has not look it over. They are charging for labor and Gary stated that they were supposed to charge for the labor. The invoice was for $3109.00 to repair it. Campbell moved to set aside the $3109.00 for the repair. Hickey second Roll call all yes. Campbell asked Gary to contact the other Company on a quote. Gary stated July 28 and 29 Twp. Rd. 150 west of S.R. 58 will be closed for a culvert repair. Fiscal Officer will post it in the paper. Gary informed the Trustees about the wooden chairs being rented out They are old and they are breaking. Hickey stated he would have to look back in his note book. He thinks the only thing they had the residences do was sign a Hold Harmless Policy. Campbell asked Hickey if the previous trustees had a policy. He stated they did and it was turned in and adopted. Sue Dembow stated that the policy had not been finished. Campbell stated we will not loan the wooden chairs out anymore. Hickey questioned Gary on the repair on Twp Rd. 581by Harris. He asked him why he didn’t put a tile in the bottom. Gary stated because there was phone line and it was shallow and he couldn’t get the Phone Co. to move it. So he had to put a French drain in and the drain is working and he will put cold patch over it. Zoning Inspector Report Spieker turned in his Zoning Reports to the Trustees. Spieker reported a neighbor on Twp. Rd.581 was complaining that his neighbor was spray painting. He went and talked with the person and he stated he does paint now and then for his self and his son. Spieker stated he does have business cards that states he fabricates gas tanks for motor cycles. Spieker advised him he could not have a business where he’s at. Spieker sent a letter to Mast on Twp. Rd. 391 and Co. Rd. 500 for a violation. He refuses to get a permit. Spieker asked the Trustees if he could set up business hours for Zoning Permits. Campbell asked him what days and times. Spieker asked about Mondays 5:00 PM to 7:00 PM and Thursdays 5:00 PM to 8:00 PM. Campbell stated might want to post on the Web Site. Trustee Report Hickey questioned the Fiscal Officer about the photos from the Appeals Hearing on June 20, 2008. She stated they would have to be printed at Irwin’s because they are in color. Hickey presented a letter about the Appeals Hearing on June 20, 2008 it sparked a lot of talk. There was a petition circulated for the removal of Tom Rozzano. Hickey read the letter. He can’t be removed immediately there has to be a process. Approximately 35 at the Hearing signed the petition. Campbell asked if all the people on the list were present at the Hearing. Hickey stated yes. Campbell asked Hickey who drafted the letter. Hickey stated Claudia Simpson did. Hickey read the ORC 519.04. Campbell requested a copy of the Hearing and the list of names of the people that was present. Campbell questioned Carol Stasisk about Rozzano. Was he anymore out of control than anyone else in the meeting, if compared to everyone else? Campbell stated that he heard it was a hostile meeting. Carol stated that he went over the top. She also stated everyone was really upset and yelling. Campbell stated the meeting was about a form that was done improperly. Some of the people that testified in the meeting were not there to testify about a form that was filled out improperly. Campbell stated he will know more when he gets a copy and reads it. Campbell stated he knows Mr. Hickey went door to door soliciting people to attend on his behalf. Campbell stated that residents call him and stated that Hickey was soliciting them under false pretenses. He was basically telling the residents that the Zoning Board was taking away the rights of the residents. The hearing was about a form. Hickey said the Zoning Inspector had done something wrong, it was not about his rights or what he was doing. Campbell stated again as he did in February, I will not force zoning against anyone in the Township until a Trustee on this board is also forced to follow the rules. Campbell stated that’s his opinion. Gary announced the Fire Department received another donation. Curtis came and serviced the doors on the Fire Station. He also donated a garage door opener for each squad. Phyllis Bauer sent him a Thank You card. Sue Denbow questioned the Trustees about getting into the kitchen to do inventory. She wanted to see what they have and get the things they need for the Chicken BBQ Saturday the 26th. She has tried to contact about 8 people for 3 days to get with someone from the Fire Department to get in. Sue would like to know who would be availably to let them in and out of the kitchen Friday and Saturday. Campbell asked Sue what stuff they needed. She stated paper plates, bowls, cups, silverware, and pampered chef. Campbell stated Phyllis would know. Jerry Bauer stated the stuff belongs to the Fire Aux. There was a name change. Hickey asked Sue if she was asking about foam stuff. She stated everything that is in the cabinet that belongs to the Ladies Aux. She stated they have not been associated with Fire Department since Steve Neff kicked them to the curve, so they were not linked the Fire Department. Sue stated that’s when the Sullivan Ladies Aux. went and got their own Tax ID number and was no longer connected to the Department. Campbell asked Sue, so you stated you are not affiliated with Fire Department. You are just a non-profit enanity. Sue stated they are non-profit. Campbell stated since you are a non-profit group and based on that fact you need to approach the Trustees for dates and time when you need the Township Building. Then it can be posted just like the Lions Club did. He has no problem working with a non-profit inanity. Campbell said when the Aux. was affiliated with the Fire Department he thought that was the way it was set back up. Hickey stated they are a separate inanity, but they worked closely together. Campbell stated for Cindy and Phyllis and the Ladies Aux. to set up a time together and decided what belongs to whom and in the event there’s a dispute it stays with the Township. Everything in there belongs to the Township unless you have a receipt. Campbell stated he’s been down that road before. Where people said things belong to them and they have walked away with things they should not have and he will not go down that road again.
