Regular Business Meeting
November 17, 2008

Campbell called the meeting to order at 7:00 P.M. Followed by the Pledge of Allegiance.

The meeting is being taped for the benefit of the Township.

Campbell moved to approve November 3, 2008 minutes Jenkins second Roll call all yes.

Campbell announced the Zoning Board of Commissions will be holding their Public Hearing on the new Resolution Book and Map on December 9, 2008 at 7:00 P.M.

Campbell moved to hold the Trustees Public Hearing on the Resolution Book and Map on December 29, 2008 at 7:00 P.M. Jenkins second Roll call all yes.

Campbell moved to hold the End of the Year Meeting on December 29, 2008 following the Public Hearing Hickey second Roll call all yes

Campbell moved to hold the Organizational Meeting on Friday January 2, 2009 at 7:00 P.M. Hickey second Roll call all yes.

Campbell asked the Fiscal Officer if there were any bills out of the ordinary, there were three. Lodi Lumber Power Plan and Pioneer Products. Campbell asked her to hold them until the end of the meeting then the trustees will make a decision.

Campbell moved to pay the regular monthly bills Jenkins second Roll call all yes.

Campbell rescinded his motion on the door for the Training Room for $336.00 Campbell moved to approve the door for $668.25 Jenkins second Roll call all yes. Campbell moved to pay the amount of the invoice to Lodi Lumber for the door and materials for the Salt Bend cost $1548.25 Jenkins second Roll call all yes.

Campbell moved pay the invoice of $5160.10 to Power Plan for the repairs on the Grader Jenkins second Roll call all yes. Fiscal Officer will send a Tax Exempt Form to Nortrax to have the taxes removed.

Trustees didn’t pay the invoice of $785.48 to Pioneer Products until the purchase of the degreaser is checked into. Campbell advised Paul to have Gary call about this issue.

Public Concerns

Richard Johnson asked if the Zoning Signs can be put up. Gary will check with the State about putting them up.

Bud Jantz asked the Trustees to donate $250.00 for the Road Patrol. Campbell moved to donate $250.00 to the Conservation Club Jenkins second Roll call Campbell yes Jenkins yes Hickey no.

Peggy Skinner turned in a certificate from the Sec. of State for a 501C3 for the Sullivan Fire and Rescue Auxiliary. If any other paper work is needed, check with Cindy.

Keith Rowe asked if the invoice was turned in for his class. He needs to be reimbursed $100.00 he paid for the class.

Jerry Bauer thanked Peggy and Donna for the excellent job organizing the Veterans Dinner.

Road Report (Paul)
Parts for the plow on the Red Dump Truck cost $1,118.40. Trustees would like to see an itemized statement for the parts.

Pickup Truck needs a Converter. Cost $380.00. Trustees advised Paul to have Gary check with someone else for a better price.

Spreader Box on the Red Dump Truck needs a new chain, cost $700.00. Trustees asked for an itemized statement before they will approve the purchase.

Paul and Gary requested the day after Thanksgiving off. They stated they will be around if the weather turns bad. The trustees approved the day off for Gary and Paul.

Paul asked about the Christmas Wreaths. He stated they need some work done on them. Richard Johnson said he would repair them.

Jenkins talked about having back up people with a CDL’S if needed to plow snow. Steve Shinsky and Ed Gregory have CDL’S and they are on the Fire Department and they already have background checks. Campbell moved to pay $10.00 an hour for extra help if needed. Hickey second Roll call all yes. A CDL list with documentation will be provided to the Fiscal Officer.

Hickey asked Paul if the backup beeper on the Grader has been repaired. Paul stated no. It’s been brought up several times. Hickey stated it needs to be repaired.

Campbell asked Paul if they had the Hydraulic lift in the shop. Paul stated they do have the complete kit.

Fiscal Officers Report

Jenkins signed the Road Crews Time Sheets

Trustees reviewed their August and September monthly reports and signed the Bank Reconciliation.

Talked with Tiffany from the Prosecutors Office about the gentleman who wrote a bad check to the Township for a Zoning Permit she stated the Township is only out the $10.00 what the Bank charged with the paperwork that would need done it wouldn’t been worth trying to get the money.

Informed the Trustees about Road Mileage sign up it will be discussed at the OTA Meeting around December 13, 2008.

Informed everyone there will be no spending after the first week in December because the Fiscal Officer will be closing the books for the end of the year.

Gave Chief Shelton the ink cartridges the Fire Department needed

Fiscal Officer Thanked Gary and Steve from the Fire Department for the caring and professional job they did when the Squad was called to her house for her husband.

Zoning report

Spieker informed the trustees that Mike from the Planning Commissions called to enquire about Business Permits and Additions.

The gentleman with the Driving Range on US 224 has removed the tool rental sign on his property.

Spieker reported that the Columbia Game Club and Kilbane just has a sign on their property they are not doing business at those properties located on US 224 they are just storing their equipment and Lieby on US 224 he doesn’t do business from his property he just stores his equipment. All of the complaints on them doing business is incorrect they are legal.

Spieker reported the trailer on Twp. Rd. 150 was burned down but the roof was still there.


Fire Chief Report

Campbell read a letter Shelton turned in from Chief Benner It was a donation from the Eagles Club of Ashland for $1000.00 for equipment at the Training Room. Phyllis Bauer got the grant for the Department.

Shelton informed the Trustees that Truck Inspection will be done once a week instead of once a month. While doing the Truck Inspection he noticed four of the five Scott Packs was dead and the valve on one of the main tanks was open.

Jerry Bauer stated the 9V Batteries may need replaced.

Shelton informed the Trustees he contacted Fireline the tanks need hydro testing. They will be here in the next couple of weeks. Last year they test 6 Tanks and replaced 1 Cylinder for $855.87. The Department will be filling 11 Tanks. Campbell moved to transfer the remaining $3,000.00 left over from the Foam Pump repair for the Tanks. Jenkins second Roll call all yes.

Shelton informed the Trustees he talked with the Captain from Wellington Fire Department and he told Chief Shelton to contact the Fire Marshall’s Office the Department may be reimburse 100% for the people they sent to the 36 hour fire class. Shelton will check into this more.

Shelton informed the Trustees the new door is on the Training Room.

Shelton stated starting January 1, 2009 he will be implementing a random Drug and Alcohol Testing. This would be setup through Community Health Partner. Drug Test $40.00 Alcohol Test $30.00. If any Test comes back positive there’s a charge of $25.00 for a Doctor to look at the test. There would be a one time fee of $100.00 for the Department Roster to be installed into the computer.

Campbell made resolution to adopt the Drug and Alcohol Policy Testing Jenkins second Roll call Jenkins yes Campbell yes Hickey no until there’s a Policy written.

Shelton informed the Trustees he started doing Training on Wednesday’s Meeting Night. Training will be mandatory starting January 1, 2009 for Continuing Ed hours for Fire and EMS. Training will be at 7:00 P.M. and the Meeting will follow. Those that do not attend the Trainings will not be allowed to attend the Meetings. Hickey stated he don’t think he can do that because the Fire Meetings are a Public Meeting. Shelton stated he’s the Chief and that’s how it will be done unless a Firefighter or EMT calls and says their working. The Fire Meetings are public and anyone can attend, but if you don’t attend the Training you will not get Continuing Ed. hours and you will not have any input in the Meetings as a Firefighter or an EMT.

Steve and John are working on the Heavy Rescue Truck and it should be in service by January.

Shelton handed in three bids to install the wall from the Community Room to the Kitchen in the Fire Department

Jenkins moved to hire Fantastic Finish Concrete & Snow Plowing for $2,600.00 Hickey second Roll call all yes. The bill will be paid out of the General Fund. The job will be completed in three days.

Shelton had a bid for the Fire Truck that was donated from Avon Fire Department. Fiscal Officer will post it in the paper under Trucks for Sale as a seal bid to be opened at December 15, 2008 Trustee Regular Business Meeting.

Trustee Report

Hickey stated he contacted the Prosecutor’s Office on November 5, 2008 and spoke to Tiffany and Mr. Spieker would have file for a dismissal against the Zoning Board of Appeals.  He is the person that filed the action so he would have to dismiss it. Hickey asked Spieker if he was willing to do so. Mr. Spieker stated he would have to speak to the other people involved and would give the board an answer at the next meeting.

Hickey asked the Chief if he had the documentation of the name change from Sullivan Volunteer Fire Department to Sullivan Fire and Rescue because he had asked the Fiscal Officer for the paper work and she didn’t have it. Chief Shelton turned in what paper work he had. Hickey stated this should be in the Public Records.

Jenkins stated the survey is done and the pins have been set and the legal description has been submitted to the Court for review. Jenkins stated the original quote that Grindle and Bender submitted could be more and he would like to submit an invoice for the extra work that had to be done.

Jenkins told him to submit the invoice that if he did the work than he should be paid. But the invoice would have to be factual. Hickey asked Jenkins if he knew what the total of the invoice would be Jenkins stated not until the Township receives the bill.

Jenkins stated he was contacted by the Road Supervisor Gary about Hickey. He feels he that Hickey is creating a hostile working environment. It was noted on Gary’s time sheet that on November 4, 2008 Hickey visited him at the Funeral and just sit there and watched him for about two hours. Gary stated Hickey approached him and raising heck with him over the air latch on the Red Dump Truck and questioned him about the Damage Report. Jenkins stated when the Truck was damaged is when Hickey was snow plowing and Truck went in the ditch. Jenkins asked Hickey if he filled out a Damage Report. Hickey stated he had left a note with Gary and he will check his notes.

Jenkins asked Hickey if he filled out the Township Damage Report or just left a note. Hickey stated he just left a note he also stated the Road Supervisor didn’t provide him with the form so they are both at fault.

Jenkins stated since this is the second time we have had people complaining about a hostile work environment. He would like Hickey to lay off the Road guys so they can do their job because it seems that you are making them feel uncomfortable.

Hickey stated he is a member of Sullivan Volunteer Fire Department and he was at the Funeral for one of his former leaders. Hickey did state that he talk to Gary a couple of times and did ask him about the tail gate latch. Campbell asked Hickey why he asked Gary that question when the discussion on the latch was moved on in a meeting and if he had any questions he should have asked then.

Campbell asked Paul if Hickey had questioned them. Paul stated Hickey didn’t ask about the latch but did look at the Truck and asked about the backup beeper and asked about the papers the Fiscal Officer had left for him.

Hickey stated we need to have an Executive Session and discuses the issues with Mr. Hollingsworth at the next meeting. Hickey stated some things belong in Executive Session. Jenkins stated that any question on decisions the Board must be made in the Public meeting since their tax dollars pays their salary.

Jenkins stated when Hickey was over the Road Crew he resigned from that position because he couldn’t get them to follow orders. Jenkins stated he does not want Hickey out stopping them from doing their job since he is over the Road Crew.

Jenkins stated to Hickey that he wanted his respect and for him to bring the problems to him or in front of Board in a Public Meeting.

Hickey stated Jenkins is being misinformed and he would like the Executive Session at the next meeting when Mr. Hollingsworth is present.

Campbell stated he will call for an Executive Session at the next meeting but Campbell stated if Hickey is trying to keep things from the public he will come out and inform them.

Chief   Shelton asked to be present in the Executive Session since Gary is an officer of the Fire Department so the issues interfere with the Department. Hickey stated he don’t think that the Chief can be present. Campbell stated the Trustees can invite anyone into the meeting.
