Regular Business Meeting
April 20, 2009

Jenkins called the Meeting to order at 7:00 P.M. Followed by the Pledge of Allegiance.

The Meeting is being taped for the benefit of the Township.

Jenkins moved to approve April 6, 2009 Minutes with the correction Hickey second Roll call all yes

Campbell moved to pay the monthly bills Jenkins second Roll call all yes.

Public Concerns

John Kenny asked about signs by the Station Gary stated he has one. Jenkins asked Gary to put it up and fix the Handicap Sign right away. Gary stated they need new signs.

Campbell moved to purchase up to $300.00 for the signs Jenkins second Roll call all yes.

Jerry Bauer stated Hickey did not state anyone’s name or who was driving the Fire Tanker when they were having Breakfast.

Carol Stasick informed the Trustees that the Appeals Board will hold a Public Hearing for a Conditional Use Permit on April 28, 2009 at 7:00 P.M. for Aaron Miller.

Roy Phillips asked why the Township was paying Ohio’s Department of Job and Family services. Fiscal Officer explained it is because there are people drawing Unemployment from the Township.

Peggy Skinner asked the trustees if the Zoning Board members and the Zoning inspector could attend Seminars. The cost for members attending is $450.00.

Hickey moved to spend up to $500.00 for them to attend the Seminar Jenkins second Roll call all yes.

Peggy Skinner informed the Trustees April 10, 2009 there was a Fire Member that did a U turn in her yard and left marks. Jenkins advised her to see Chief Shelton after the meeting and he will take her statement.

Janice Steele asked Chief Shelton if the Fire Department Meetings are open to the Public. The Chief stated yes they are but the Training is not.

Jenkins moved by Resolution to enter into an Executive Session at 8:00 P.M. to review a legal opinion from the Prosecutors Office and to go over Personnel issues. Campbell second Roll call Campbell yes Hickey yes Jenkins yes.

Jenkins moved by Resolution to enter back into the Regular Business Meeting at 8:13 P.M Hickey second Roll call Campbell yes Hickey yes Jenkins yes.

Jenkins stated for the review of the Legal Opinion they will give the Zoning Inspector a copy of the Opinion. Campbell stated the opinion was concerning issues with horses on less than two acres of land.

Hickey stated for the record that the Zoning Inspector should have all communications on Zoning not just certain ones. He stated that he should have both Opinions.

Jenkins asked Hickey if he would go against the advice of the Prosecutors and give any and all Legal Opinions to the Zoning Inspector. Hickey stated as far zoning is concerned yes. Fiscal Officer gave Spieker a copy.

Jenkins stated there was no action taken on the Personnel Issue.

Fiscal Officer Report

Fiscal Officer informed the Trustees the quote they received for the dumpster at the Garage can change if the Fuel Charge changes monthly. Trustees decided to stay with the monthly garage pickup.

Fiscal Officer informed the Trustees the Township does not receive the Electric bill in mail they have to fax the bill every month to the Township. L.M.R.E. state that another Township has the same problem they will try to get the problem resolved

Fiscal Officer explained that L.M.R.E. did not receive the Electric bill for last month of $600.35 there was a stop payment put on the check. The bill for two months was $1021.00. Trustees approved and signed the check. Fiscal Officer will check to see if the problem has been corrected.

Fiscal Officer turned the Road Crews Time Sheets Jenkins signed them.

Fiscal Officer gave copies to the Trustees from the County Engineers Office to vote on a nominee for The Ohio Public Works Commission that is known as Issue I program.

Fiscal Officer gave copies to the Trustees of the Application for CDBG Grant from the Ashland County Planning Commission. To be filled out and retuned to Tim Cooper by May 14, 2009

Hickey stated if should be filled and try to get a roof of KO NO CO.

Fiscal Officer had the key for Hickey for the Township Community Board Hickey stated the Fire Department has been doing the sign so he will not need the key. Chief Shelton stated if anything needs to be on the sign fax it to the Station and it will be taken care of.

Fiscal Officer stated that Jenkins and Gary called her about the Township Cell Phone that Gary has. He dropped the phone in the ditch and it no longer works. Fiscal Officer turned her Township Cell Phone over to Gary and she will have his number changed to the other phone.

Fire Report

Chief Shelton announced they are canceling the Pancake Breakfast for May 2, 2009. The Chief stated they are having an open house from 8:00 A.M to 1:00 P.M. and they will provide Hot Dogs at the Fire Station.

Chief Shelton informed the Trustees that Litchfield now has their New Tanker and the Old Tanker we purchased from them should be here in Sullivan by the end of the week.

Chief Shelton turned in an invoice from Dynamic Sign Co. for the lettering on the two new vehicles the cost $21.50.

Campbell moved to reimburse Keith Rowe for the $20.00 Jenkins second Roll call all yes Hickey stated he can not be reimburse the sales tax since the Township is tax exempt. 

Chief Shelton thanked Sam and Jonas for the Tarp work they did for the Engine and they are making two covers for the portage tanks. Jenkins thanked them for their work.

Campbell moved to pay Harrison Ford for the Starter Motor on the Heavy Rescue Truck cost $299.78 Jenkins second Roll call all yes.

EMS Report

Chief Benner tuned in an invoice for Oxygen Tanks from Valley National Gases cost $68.24 

Road Report

Gary informed the Trustees that Millron can not provide the ten dumpsters they need for Clean up Day.

Campbell moved to rescind his motion to contract with Millron Hickey second Roll call all yes.

Campbell moved to contract with Allied Waste for Clean up Day Jenkins second Roll call Campbell yes Jenkins yes Hickey no. Jenkins signed the contract Fiscal Officer will fax it to Allied Waste.

Hickey had quotes from Krystowski and Farm and Home on mowers for the Township Hickey stated they would let the Township use a demo before they make a decision to purchase. Polen Implement did have a roll over program Hickey had no quote from them

Jenkins asked Gary to get some demos and quotes to see which one would do the job that they need for mowing.

Gary informed the Trustees that Callihan Electric, Inc. would do the Electric to the Gazebo and the Community Sign for $1000.00, Trustees advise Gary to get other quotes.

Gary informed the Trustees the roof of the Records Room needs repaired.

Campbell moved to have Steve Shinsky do the repairs on the Records Room no to exceed $1000.00 Jenkins second Roll call all yes.

Zoning Inspector Report

Spieker turned his monthly report to the Trustees and Fiscal Officer

Spieker advised the Trustees AJ from the Health Department called asking where the Township was with the Sewer Systems. Spieker told AJ to get in touch with Hickey.

Spieker informed the Trustees that Price Septic is licensed to dispose of sewage on Home Owners land.

Spieker turned in a letter requesting the Zoning Board of Commission Audio Minutes from February and March 23, 2009 Meeting. He informed the Trustees that he has requested the Audio from that meeting and has not received it. Spieker was informed he can not have them until the minutes have been approved. Peggy Skinner advised him that she sent the Audio out to be copied and he would receive it.

Skinner from the Zoning Board of Commission’s stated she taped over the Audio’s of their Meetings because she was not able to down load the Audio’s to the Computer from January to March 23, 2009.

Spieker told Hickey that he should know the out come of his Public Hearing since he received a copy of it from the Prosecutors Office. Hickey stated he would like something as an individual for closure. Jenkins asked Hickey if he was in compliance with the Township Zoning. Hickey stated yes. Jenkins asked Spieker if Hickey was in compliance with Zoning and if he had sent him any violation letters. Spieker stated yes.

Peggy Skinner asked the Trustees if she can get a copy of the Legal Opinion that Spieker received. The Fiscal Officer will get her a copy. Jenkins stated she will receive what ever is released to the Zoning Inspector.

Trustee Report

Hickey requested the Trustees change the Meeting of May 4, 2009 because he would be at a Meeting on the Pipeline. Jenkins stated the Meeting can not be changed.

Hickey stated he had no response from Troy or Ruggles on the Gov Now Project.

Hickey stated he is still waiting on the form from the farmer for the water way project on Twp. Rd. 150

Hickey turned in a copy of his Public Records Training Certificate.

Hickey stated he did not have a copy of the letter from L.M.R.E. Campbell had his copy. Fiscal Officer made him a copy.

Hickey stated as a result of the bill he would like to send a letter to Mr. Brent with L.M.R.E that he wrote. Campbell stated it is at the Prosecutors Office and he would like to wait for the Legal Opinion to come back.

Hickey turned in a letter to the Township and the Fire Department for Public Record about the allegations that Mr. Whiteford made against him. Hickey asked for an investigation on Mr. Whiteford. The Trustees had a discussion on the allegations and no action was taken. The letter is attached to the Minutes.

Hickey had the list from EMA about billing residents for Fire Calls. Jenkins stated he would not bill the Residents for Fire Calls since they pay for the service already with a Tax Levy. Hickey asked the Chief if the EMA list was posted in the Station. Chief Shelton stated yes. The issue was tabled.

Hickey and Gary will attend a meeting at the Ashland County Engineers Office April 21, 2009 on Bridge Repairs.

Hickey asked Chief Benner if he could review the Surveys they sent out to patients. Chief Benner stated that is confidential because of HIPPA. Jenkins stated they can review them in Executive Session.

The Trustees review the News Letter. Jenkins moved to approve the letter. Campbell second Roll call all yes. Fiscal Officer will e-mail the information to Art Printing.

Jenkins announced the Road Project for 2009 will be 9 miles.
   Twp. Rd. 150 to Twp. Rd.391 west to Township Line 3.5 miles      
   Twp. Rd.391 from US Hwy 224 south of Co. Rd.500 2.5 miles
   Twp. Rd.581 north to Co. Rd. 40 and all Twp. Road within Town

The bids for all ditching, French drains, culvert repairs will be the responsibility of the Contractor.
