Sullivan Township Trustee Attendance Duane Jenkins Chairman Jenkins called the Meeting to order at 7:00 P.M. Followed by the Pledge of Allegiance. Jenkins announced the Meeting is being taped for the benefit of Township. Campbell moved to pay the bills Hickey second Roll call all yes. Trustees signed checks #20161 thru #20182. Campbell moved to approve June 15, 2009 Minutes Jenkins second Roll call Campbell yes Jenkins yes Hickey abstained. Campbell moved to approve July 6, 2009 Minutes Hickey second Roll call all yes. Campbell moved to approve July 17, 2009 Budget Hearing Minutes Hickey second Roll call all yes. Campbell moved to approve July 21, 2009 Special Meeting Hickey second Roll call all yes. Campbell moved to rescind his motion on March 2, 2009 to advance $4500.00 from the General Fund to the Fire Fund to purchase the Engine and Tanker from Litchfield they agreed to wait until the Township received the tax money in April Jenkins second Roll call Campbell yes Jenkins yes Hickey no. Campbell moved by Resolution to repay the advance of $11,000.00 from the EMS Fund back into the General Fund Jenkins second Roll call as follows Campbell yes Hickey yes Jenkins yes. Jenkins explained the Levy. If approved it will be a 2M that would go into the General Fund to be used for Fire, EMS, Cemeteries, Township Roads, Township equipment, and repairs etc. Jenkins stated that according to the Auditor based on a $100,000.00 dollar home the cost would be $61.25. Jenkins stated at the meeting in September he will have a letter from the County Auditor explaining how taxes are collected and how the property value is assed. Jenkins read the Resolution #01 of declaring the intent to proceed on an additional tax Levy for a 10 Mill limitation. Jenkins moved to adopt the Resolution for the 2M levy for five years to be placed on the ballot November 3, 2009 Campbell second the motion Roll call as follows Jenkins yes Campbell yes Hickey no Fiscal Officer signed the certificate authenticating the original Resolution adopted August 3, 2009 of the Sullivan Board of Trustees. Campbell moved to hold a meeting on August 10, 2009 at 6:00 p.m. for the second reading of the Resolution on the levy. Jenkins second Roll call all yes. Fiscal Officers Report Jenkins signed the Road Crews Time Sheets Fiscal Officer presented the Trustees photos of the weeds along Mr. Johnson’s fence. They were mailed to the Township by Mr. Zarfis. Fiscal Officer presented the Trustees with a Cemetery Deed to be signed. Witness by Peggy Skinner and Janice Steele. Janice Steele notarized the Deed. Trustees reviewed and signed the Bank Reconciliation. Trustees signed they received their April monthly reports. Fire and EMS Report Chief Shelton interview two people to join the Fire Department Laura Bacisin she is a 240 hour Firefighter and an EMT she is waiting to take her test, and Ashlee Royster an EMT. She has already taken the class and is waiting to take her test. Hickey moved to put Bacisin and Royster on the Fire Department with the recommendation of Chief Shelton Jenkins second Roll call all yes. Chief Shelton turned in his monthly mileage report for the Command Unit 2701.He also turned in the following invoices. One from Pro Air for Air Pac’s, one from A&M Fire for cylinder repair, and one for Charles Seese Fire Fighter class in Oberlin. Road Report Gary advised the Trustees that the flag pole at the Cemetery needs to be replaced. Hickey advised Gary and the Board that the flag pole in the Memorial Park needs to be replaced at the same time. Jenkins advised Gary to get quotes on two flag poles and he will check with the VFW Post and see if they can help with some of the cost because a lot of Veterans are buried in the Cemetery. Jenkins stated he wants 50’ poles in the Cemetery and the Memorial Park. Gary advised the Trustees that he has started the ditch mowing and he will have Twp. Rd. 150 and 581 North of 224 Chip and Sealed by the end of the month. Hickey advised Gary of a drainage problem on Twp. Rd. 150 by Simme, and at 425 Twp. Rd. 150 the culvert needs repaired and the cross over pipe is the ditch needs to be cleaned out. Hickey turned in a request for ditch dirt from Simme he advised map of where to dump the dirt is on the back of the request form Richard Johnson asked about a culvert on Twp. Rd.150 by Cindy’s home that needs to be cleaned because water stands there all the time. Hickey advised Gary to us the transit on it. Jenkins asked Gary if he has that complaint down Gary stated he does. Jenkins asked Gary if he was doing regular maintenance reports and if there kept up to date on the equipment. He asked Gary if the power washer was being used and the oil changes were kept up to date and if the vehicles are kept cleaned. Gary stated yes. Jenkins stated he received a call on July 23, 2009 at 7:00 p.m. from Phyllis Bauer. She stated that the Cemetery did not look good. Jenkins agreed that the Cemetery did have tall weeds. Campbell also stated he received a complaint so he drove through the Cemetery and it did not look good. Gary stated they were doing the culvert repair and Steve could not mow due to family issues. Jenkins advised Gary he would have to manage his time a little better. Zoning Report Spieker turned in zoning reports to Peggy Skinner on the Zoning Board of Commissions and he turned in his July Zoning Report. Spieker stated that the property at 110 St. Rt. 58 is still not resolved and that he has been in contact with her and she did not want to talk about the issue. Jenkins stated you did your best to help her resolve this issue. Spieker turned in his resignation letter. He stated he resigned because of health reasons. Campbell read the letter to residents and the letter is attached to the minutes. The Trustees accepted his resignation and stated that his health is more important. Jenkins thanked him for the great job he did. Campbell stated we need to address the issue of a Zoning Inspector. Hickey moved to post the position. Campbell stated there is too much going on so when I found out Spieker was resigning I thought it should be someone who knows the zoning so I contacted Peggy Skinner. She is on the Zoning Board and she knows the zoning and she help put the Zoning Book together. Also, she is around during the day and she would be will suited for the job if she would accept the position. Campbell asked Peggy Skinner if she would be interest in the Zoning Inspector position Skinner stated yes. Campbell moved to appoint Peggy Skinner as the new Zoning Inspector Jenkins second Roll call as follows Campbell yes Jenkins yes Hickey no. Jenkins stated that Skinner is more qualified to do the job because of her experience on Zoning Board and helping to get the map and text together that is in infect now. Campbell moved to post the positions in the paper for the Zoning Board of Commission and the Zoning Board of Appeals. Resumes will be opened on September 7, 2009 at 7:00 p.m. Hickey second Roll all yes. Fiscal Officer will post the positions in the paper. Trustee Report Hickey reported that all the paper work is back from the NRCS for the project on Twp. Rd. 150. Hickey suggested the Trustees should call a special meeting to meet with all the property owners and decide what they are going to do to get the drainage problem cleaned up. Jenkins asked Hickey if it was a protected wet land. Hickey stated it was not everything has been cleared to proceed with the project. Campbell asked what the project was. Hickey stated it was to clean the brush and the salient out of the ditch way the farmer is willing to have it put in the field. Campbell asked Hickey about the study and what was in it... Is it just the one farm or does go to the Township line. Hickey stated it just included the water way back to the woods. Campbell stated by doing this it might create more water. Hickey stated it could not be any worse than it is now. Hickey stated that Soil and Water can only clean the water way to the woods because of the habitat close by. Hickey stated the study is the conclusion of Soil and Water out of Ashland. Hickey read the letter from Soil and Water. Letter is attached to the minutes. Campbell stated he is in favor of the meeting because he would like to get the problem solved. Jenkins moved by Resolution for Hickey to contact the Prosecutors Office for the purpose of setting up a meeting with all people involved. Campbell second Roll call Campbell yes Jenkins yes Hickey yes. Campbell stated they need Soil and Water on site to answer any questions and solve the problem. We also need some one from the Prosecutors Office present that can answer on the Trustees behalf. They can have an opinion back within thirty days that would let the trustees know what steps to take. Hickey gave Gary information from Soil and Water to read. He also turned in information for public record on ditch digging for Gary. Hickey stated when he was doing the adopt a Highway Program he noticed part of the sidewalk was removed at 512 US Highway 224 and the debris was laying on the sidewalk. Hickey prepared a letter to the Trustees that he read along with a picture that is attached to the minutes. Campbell asked if we received the paperwork on the Issue II money for Twp Rd 391. We need the paperwork so we can bid the project. Fiscal Officer stated no. Campbell stated he had talked with Donna from the State and she wanted to know why we had not submitted the bid. Campbell stated we had not received the paperwork. Campbell will follow up on this. Campbell informed the Board that he will be meeting with Jim Lytle to get his recommendation on approximately seven miles of road to be chip and seal. He would like to look at Twp. Rd. 391 south, Twp. Rd.150 west, and Twp. Rd 581 north of US Highway 224. Campbell informed the Board that he has not heard anything about the Bridges on 391 and 150. Mr. Mexiner was talking to the Commissioners and CSX about this issue. Hickey said about two and half weeks ago they had a crew doing the Environmental study. The study was done here in Sullivan at the bridge on 391 as stated by Hickey. Public Concerns Les Handley informed the Trustees about ruts in the ditch. Gary is to get in touch with Bartley and Bolin since it was there truck that did the damage. Les stated the ditch needs to be cleaned out because you cannot see his culvert. Jenkins asked Gary what his plans are. Gary stated he would get to it as soon as he could. Jenkins asked when he would have it done. Jenkins stated to Gary it will be taken care of by the end of September. Gary stated yes. AJ asked the Trustees if Gary could bring the backhoe over to the station to change the lights. The trustees stated yes... Wes Williams the Fire Chief from Troy Township was at the meeting because of the rumors that were going around. He stated if anyone has questions about the Emergency call at Town and Country I am here to respond to any questions you may have. Chief Williams stated that he was in charge and he gave the orders. Campbell stated he heard everyone done a great job. Chief Shelton was in Sandusky when he was notified and he did make it to the call. Hickey thanked them for the mutual aid help. Janice Steele made a public request for a list of loans the Township owes. Fiscal Officer informed her that the only loan the Township owes is to the Ohio Public Works Commission for the project on Twp. Rd. 462.$12,000.00 a year. $5,997.00 every six months paid for 20 years until 2025 and it is an interest free loan. Richard Johnson talked about the following issues. Repairing the road berms, removing the trees and cattails on Twp, Rd. 581 and Twp. Rd. 150, and the bushes on Co. Rd. 281 and Twp.350. Gary stated he was in contact with County and they said it was the home owner responsibility. Gary will follow up on these issues. Jerry Bauer and the Trustees had a discussion about Fire Department Issues. Campbell moved to release the contents of an Executive Session on July 6, 2009. Jenkins second Roll call all yes. In the Executive Session there were some issues with the EMS Chief and when they returned back to the Regular Meeting they decided to abolish the position to save money. Jenkins stated that Cindy was not fired it was a cost reduction to the Township they decided to go with one paid position. Jenkins stated they wanted her to stay on the Department and to the best of his knowledge she is still a member. Jenkins stated they did not fire her or demote her they praised her for the job she did. Mark from Co. Rd. 281 stated he had a car on his property that was leaking gas, and he would like to know who he should contact to have it removed. He was advised to call the Sheriff’s Department. Campbell stated the letter that that was placed on the back table is full of lies and everything in it can be disputed Jenkins moved to adjourn at 8:55 p.m. Campbell second Roll call all yes.
