Regular Business Meeting
November 16, 2009

Jenkins called the Meeting to order at 7:00 P.M. Followed by the Pledge of Allegiance.

Jenkins announced the Meeting is being taped for the benefit of the Township.

Hickey moved to approve the minutes for October 19, 2009. Jenkins second Roll call all yes.

Hickey moved to table October 23, 2009 minutes until Janice Steele is present to confirm a statement about insurance that is in the minutes. Campbell second Roll call all yes.

Campbell moved to approve November 2, 2009 minutes Jenkins second Roll call all yes.

Campbell moved to pay the monthly bills. Hickey second Roll call all yes. Trustees sign checks #20326 thru #20347

Hickey questioned Lytle Construction’s invoice Fiscal Officer informed him it was for all the chip and seal that was done on the Township Roads.

Public Concerns

John Kenny asked about the hole in the ditch on St. Rt. 58 by the old Eaton Farm where the truck accident happened and if it could be repaired.

Hickey stated that 58 is a St. Rt. and they would need to get in touch with the State or with EMA to have the repair done.

Melody Walkman gave the trustees information about a free Thanksgiving Dinner. Jenkins posted the information on the board in the Community Room.

Fiscal Officer Report

Fiscal Officer informed the Trustees they had copies of Meyers Electric quote for the surveillance cameras.

Campbell moved to table the quote until the next meeting so they can review it. Jenkins second Roll call all yes.

Fiscal Officer asked about the doors that J&J Construction was to install at the Community Room.

Gary stated he will get in touch with Chris Jordan.

Jenkins signed the Road Crews Time Sheets.

Fiscal Officer informed the Trustees that the Winter Conference Trade Show is February 17 thru 20 and the dead line to register is January 29, 2009.

Hickey stated he would like to attend the Conference if the Township would pay for the room at the Red Roof Inn and this year he would not charge the Township for mileage.

Hickey moved for the Township to pay for his room at Red Roof Inn there was no second. The motion died. Hickey stated he would still be going.

Campbell stated due to the financial situation he would not like to see anyone go.

Hickey stated they should attend the Conference and that it is important to work with other Trustees, State Leaders, and attend the classes.

Fiscal Officer informed the Trustees about the culvert pipe that was the wrong size and that ADS will be charging a 20% restocking fee plus  a pickup and delivery fee.

Trustees and Gary had a brief discussion about the pipe and the charges. Hickey stated the township should not pay for Gary’s mistake.

Jenkins asked Gary to call ADS and see if he can work something out on the restocking fee. Gary stated he will call them.

Fiscal Officer informed the Trustees that Walker Hartman gave her a check for $1.35 for copies of the Miller property on St. Rt. 58.

Fiscal Officer gave the Trustees a letter that was handed to her in the meeting. Campbell read the letter. It was Walker Hartman’s resume to fill the position on the Zoning Board of Appeals.

Campbell moved by Resolution to appoint Hartman to the Appeals Board in Roy Phillips spot. Hickey second Roll call Campbell yes Hickey yes Jenkins yes.

Campbell moved by Resolution to enter into Executive Session at 7:30 p.m. to discuss Ohio Billing. Jenkins second Roll call Campbell yes Hickey yes Jenkins yes.

Campbell moved by Resolution to enter by into the Regular Business Meeting at 7:32 p.m. Hickey second Roll call Campbell yes Hickey yes Jenkins yes.

Fire and EMS Report

Chief Shelton informed the Trustees that they need 6 buckets of foam. Cost $408.00

Campbell moved to purchase the foam for $408.00 Hickey second Roll call all yes.

Chief Shelton informed the Trustees there are three fire fighters that would like to take their EMT class at Lorain County JVS John Brown, Steve Shinsky, and Justin. Cost for each class $720.00.  

Campbell moved to send the Firefighters to class with the Chief’s recommendation at the cost of $2160.00 Jenkins second Roll call all yes.

Road Report

Gary informed the Trustees he needs to order two slow children signs cost $27.40.

Campbell moved for Gary to purchase the signs at $27.40 Hickey second Roll call all yes.

Gary informed the Trustees the Heater Coil went out in the Red Dump Truck and he needs to order one and the fender on the Dump Truck came off when Steve was dumping a load.

Gary stated they can get the fender from Akron Medina Truck Sales for $75.00 but they would need to pay for it in advance.

Campbell moved for Gary to purchase up to $200.00 for the Heater Coil and fender Jenkins second Roll call all yes.

Fiscal Officer will have the check for $75.00 to pay for the truck fender at the next meeting.

Gary informed the Trustees that Twp. Rd 350 will be closed between Co. Rd. 681 and Twp. Rd. 581 for three days beginning Monday November 23, 24, and the 25 for culvert repair. Fiscal Officer will post it in the paper.

Hickey asked Gary if he had done anything with the culvert on Twp. Rd. 350 east of Co. Rd. 281. Gary stated he cleaned the ditch and the water is flowing across through the culvert.

Hickey asked Gary if he had bermed on Twp. Rd. 212. Gary stated he will be doing that work this week.

Hickey asked Gary if he had pulled the culvert permit for 246 Twp. Rd. 391. Gary stated that he gave the permit to the gentleman but never got it back. Gary stated he could not find the permit in the records and he looked all the way back to 2004.

Hickey stated that the Township is not responsible for the $800.00 it cost for the removal of the concrete and replaced it with blacktop. Hickey stated that this occurred in the project area on Twp. Rd. 391 and the guidelines for installing culverts were not followed...

Jenkins told Gary to keep an accurate log of the culvert permits and follow up on them.

Hickey asked Jenkins since he is the Trustees over the roads if he would write a letter to the resident about the cost. Jenkins stated he would not.

Hickey stated he would draft the letter for the next meeting for approval by the Board.

Hickey told Gary to patch a hole on Twp. Rd. 391 north of 307 there is four orange strips in the center of the road. Gary stated that they have some cold patch for the repair.

Zoning Report

Skinner stated she would like to have copies of the culvert permits to go with the new home permits because she knows the culvert on Twp. Rd. 350 was disapproved.

She stated that she sent two letters out and she has not had any response from them. She stated she will send them a letter by certified mail, and if she does not get a response from them, then she will turn it over to the Trustees.

Skinner stated there was a permit issued in 2003 for an addition to a home and it turned out to be a mess. Skinner stated that she could not give him a permit and she advised him that he could go in front of the Zoning Board of Appeals and try to get a variance. She stated that duplexes and mixed dwellings are not permitted in that zone.

Hickey asked her where the location was. Skinner stated it is on US Highway 224 where Sam Cowick had done many lot splits on his farm and they were not correct because they did not use the frontage that was required.

Hickey stated he received a call from Kelly Kanzeg about Terri Sizemore who has the Vet Clinic on US Highway 224. Skinner stated she had not contacted her but she stated that it is a personal matter that has nothing to do with zoning. Hickey stated when he spoke with her he also thought that it was personal.

Trustee Report

Hickey presented a culvert replacement form that Chris Schrock on Twp. Rd. 150 had filled out. Hickey stated about 60 feet of culvert would need to be placed in the ditch to take care of the water.

Hickey moved to have Gary install the culvert there but was no second to the motion.

Trustees had a brief discussion on the culvert issue. Campbell read the form and stated it did not have the correct Officials names on it, and the adoption date was not on it either. He stated on the form it had 40 foot of culvert pipe is required instead of 20 that the County requires. Campbell stated the form is no good. Hickey stated they have been using that form for two years.

Jenkins stated according to an opinion from the Prosecutors Office they can not replace any resident’s culverts unless it causes damage to the road. Culvert form attached to the minutes.

Hickey stated he is in contact with Matt Blankenship with the State about this issue and they do replace culverts but not on a regular basis he will try to get the policy.

Campbell moved by Resolution to appoint Tom Razzno to the Zoning Board of Appeals beginning January 1, 2010 thru December 31,2015 Jenkins second Roll call Campbell yes Jenkins yes Hickey no.

Campbell moved by Resolution to appoint Carol Stasick that was filling Peggy Skinner’s unexpired term on the Zoning Board of Commissions beginning January 1, 2010 thru December 31, 2015. Jenkins second Roll call Campbell yes Jenkins yes Hickey no vote.

Hickey stated that all of this is to be done on January 1, 2010 Business Meeting.

Campbell read a statement about certain Candidates for trustee was out talking to residents and spreading lies about the first responder vehicle that Chief Shelton drives and at the beginning of the year there would be changes within the Fire Department.

Hickey stated that everything was just hear say. And he would like the names of the people.

Campbell moved by Resolution to amend the Fire Chief’s contract Jenkins second Roll call Campbell yes Hickey no Jenkins yes. Contract attached to the minutes.

Campbell moved by Resolution to send the Contract to the Prosecutors Office for a Legal Opinion to see if it is a Legal and Bidding Contract. Hickey second Roll call Campbell yes Hickey yes Jenkins abstained.

Campbell asked about the Opinion that was suppose to be sent to the Prosecutors Office about Hickey having a radio and key to the Fire Department and why they have not receive that Opinion back.

Jenkins will contact the Prosecutors Office about this issue.
