Regular Business Meeting
June 1, 2009

Jenkins called the Meeting to order at 7:00 P.M. Followed by the Pledge of Allegiance.

Jenkins announced the Meeting is being taped for the benefit of Township.

Campbell moved to pay the monthly bills Hickey second Roll call all yes Trustees signed checks 20056 thru 20082.

Campbell moved to approve May 18, 2009 Minutes with the correction. Hickey second Roll all yes.

Public Concerns

Janice Steele asked the Trustees if a flyer could be posted on the Web-Site about the Farmers Market. Jenkins stated they will address that later in the meeting.

Steele also spoke about the reverse 911 for cell phones for people who do not have a land line or a private number. They can go on line to Efficient Gov Now and register their phone and they can vote yes or no for an $85,000.00 grant that help pay 90 % of the cost.

Steele presented the Trustees with pictures of the Cemetery taking on Monday June 1, 2009. The pictures showed grass on the Head Stones and she stated the flowers were weed whipped. She also stated that an Angel was broken. Shinsky stated the Cemetery was not weed whacked that day Monday June 1, 2009.

Steele informed the Trustees and the Fiscal Officer that the Township did not follow the proper procedures according to the Unemployment Guide. She stated that the people on Unemployment should be offered the position first before it is posted in the paper or they do not have to apply for the position. She stated that this information is in the guide book.

Steele stated she is not required to apply for the Mowing Position since her job with Township was clerical and was out of her classification.

Campbell stated the board was going by what Hickey stated. Hickey stated that the first part of the process was to send the letters to those on Unemployment. He also stated that he voted no on posting the Mowing Position in the paper. He wanted to wait until the people on unemployment were contacted.

Hickey stated the Board should consider the money that is being paid out for unemployment.

Campbell stated Hickey did not inform the Board of the proper procedures on how to move forward to contact those on unemployment. Campbell stated Hickey was to look into this further. Hickey stated it is not his job. He stated that it is the Fiscal Officers responsibility. Steele also stated it is not the Trustees job it is solely the Fiscal Officers job. Steele stated she would like the minutes to reflect by all means it was nothing personal against the Fiscal Officer

Jenkins stated Hickey gave out bad information and did not inform the Fiscal Officer it was her responsibility.

Fiscal Officer will look into the unemployment issue.

Keith Rowe asked the Trustees what their opinion would be if they are reelected and the Fire Levy fails again. He asked the trustees are you in favor of billing each resident in the Township on a per call bases who has lost their home in fire.

The trustees stated their opinion on billing the residents in the township for Structure Fires. They all stated no.

Fiscal Officer Report

Fiscal Officer informed Chief Benner that invoices for the Township can not have anything redacted.

Hickey asked Chief Benner what was under the white out Chief Benner stated her address. Hickey asked her was it a ship to address and she stated yes.

The Trustees stated anything order for EMS will be shipped to the Fiscal Officers address.

Fiscal Officer informed Chief Benner that all original run sheets will be turned into the Township at the end of the month and they are to keep copies.

Fiscal Officer gave the Fire Department their Ink Cartridge.

Fiscal Officer gave David Spieker the Zoning Inspector his Ink Cartridge.

Fiscal Officer informed the Trustees they received two Chip and Seal Bids

Sarver Paving Co.

Campbell moved to hire Lytle Construction LLC to do the Chip and Seal Jenkins second Roll call all yes. Bids are attached to the Minutes.

Fiscal Officer informed the Trustees that there were no Findings for Recovery on Lytle Construction LLC

Fire Report

Chief Shelton turned in his mileage sheet for 2701 the Command Unit.

Chief Shelton informed the Trustee that 2711 will be out of service for an hour. It was taken down to Polk for them to look at. They want to purchase one like we have.

Chief Shelton informed the Trustees that the four firefighters have completed their 84 hour transition course and will be taking their State Test on June 2, 2009.

EMS Report

Chief Benner turned in a check for the training grant they received. They received $4700.00 of the $5500.00 and they will receive the rest when she turns in the invoice for James Wolfe’s class.

Chief Benner turned in envelopes to be mailed to Ohio Billing.

Road Report

Gary asked the Trustees about ordering one load of dust bond. The trustees tabled his request until the next meeting.

Gary asked the Trustees about ordering Brim. Trustees tabled the Brim until Gary does the research for the next meeting.

Hickey asked Gary to take a look at the Ditch on Twp. Rd. 391 and Twp. Rd. 462. He thinks it should have a tile installed.

Gary stated they have started mowing township roads.

Zoning Report

Spieker turned in his monthly report.

Spieker informed the Trustees that he sent out four certified letters for violations and three were returned.
Spieker informed the Trustees that one resident complied and he would like to move forward on the other two. He asked for them to be sent to the Prosecutors Office.

Spieker spoke with the owner of abandon house on Twp. Rd. 462 and informed him he would have to tear it down or fix it up. The owner told Spieker he will see what he can do to solve the problem.

Trustee Report

Hickey spoke about the County Township Association Meeting and the revised budget from the County Auditor. He advised the Fiscal Officer to contact him so she would be informed of what he was talking about.

Hickey informed the Residents there were copies of the Meeting from last month on the table.

Hickey read his revised proposal for Fire Department Billing. Hickey stated it is the same proposal except he took out Structure Fires. His letter is attached to the Minutes.

Hickey moved by Resolution to forward the letter to the Prosecutors Office. Campbell second Roll call Hickey yes Campbell yes Jenkins yes.

Campbell stated we need to ask the prosecutor about the wording and the correct way to do the billing. Fiscal Officer will send a letter to the Prosecutors Office of the Resolution on the Township letterhead. I will fax it to them before 10:30 a.m. I will also let them know that Hickey stated he would be in to talk to them about the billing since he will be in Ashland around 10:30 a.m.

Campbell moved to enter into Executive Session at 8:25 p.m. to discuss a letter from Perso about the lawsuit and to review a legal opinion from the Prosecutors Office about destroying Public Records Jenkins second Roll call Campbell yes Hickey yes Jenkins yes.

Campbell moved to enter back into the Regular Business Meeting at 8:40 p.m. Hickey second Roll call Campbell yes Hickey yes Jenkins yes.

Campbell moved to table the legal opinion until next meeting Hickey second Roll call Campbell yes Hickey yes Jenkins yes. Fiscal Officer gave Peggy Skinner a copy of the letter for the Zoning Board.

Campbell read a letter addressed to North Coast Wireless Communications to cancel the contract that the Township has with them for the web-site. Campbell stated he would like to find someone in the Township to maintain the website. The letter is attached with the Minutes.

Hickey stated it should not be discontinued until the Township finds someone to take it over because a lot of people go to the web-site for information.

Campbell moved to cancel the contract Jenkins second Roll call Campbell yes Jenkins yes Hickey no.

Janice Steele wanted it noted in the Minutes that the pictures on the web-site are her own personal pictures and she wants them removed. Campbell stated that the trustees would have to ask the Prosecutor if they belong to the Township and are public records since they were posted on the web-site.

Jenkins stated the Prosecutors Office did not receive the letter requesting someone to be present at the June 1, 2009 Meeting and about the legal opinions on Zoning. They stated they did not receive the letter.
Jenkins asked the Fiscal Officer if she had faxed the letter to them and she stated she did.

Jenkins stated he talked with Mike from the Prosecutors Office and he stated they might have been over looked because of their work load.

Jenkins will follow up with Mike to have someone at the July 1, 2000 Meeting and to comply with the Township Records Request.

Jenkins moved to terminate the Alternates on the Zoning Board and the Appeals Board to save money. Campbell second Roll call Campbell yes Jenkins yes Hickey no.

Gary asked the Trustees about knifes for the ditch mower 22 would cost $209.00. Trustees told Gary to order them it was within his budget.

Jenkins moved to adjourn at 8:55 p.m. Campbell second Roll call all yes.
