Special Meeting
December 20, 2009

Jenkins called the Meeting to order at 7:00 P.M. Followed by the Pledge of Allegiance.

Jenkins announced the Meeting is being taped for the benefit of the Township.

Campbell asked everyone to stand for a moment of silence for Jerry Sayles who passed away on Tuesday.

Campbell moved to pay the monthly bills Jenkins second Roll call all yes.

Fiscal Officer
Trustees signed the October 23, 2009 Minutes.

Jenkins signed the Road Crews Time Sheets.

Turned in a letter to the Trustees Jenkins read the letter from James Riley for the position on the Zoning Board of Appeals Campbell moved to appoint James Riley to the Zoning Board of Appeals in Jerry Sayles unexpired term Jenkins second  Roll call Campbell yes Jenkins yes Hickey abstained.

Pubic Concerns

Asking why they were having a meeting on Sunday and why the attack on Hickey. Campbell stated he has to hold Hickey accountable as a Trustee for his action on zoning the same he would a resident. Campbell stated you the Oath of the laws of the State of Ohio. Hickey stated no he took the Oath to up hold the Constitution.

Faye Schwab requested all records pertaining to this issue. Jenkins stated the letters from the Prosecutors Office is Confidential. Campbell stated they will review the letters before they are released.

Hickey stated he came to the Hearing that he did not ask for and had requested the following from the Board of Trustees.

1- Name the vehicles they deem to be Junk.
2- Describe the nuisances in the process that they had determined.

Hickey stated he has not received an answer from the Board.

Jenkins stated according to the ORC they can inspect his property after the fourteen days from receipt of the letter. Jenkins stated without the inspection the Board can not determine what is junk. Jenkins stated Hickey was contacted by certified mail, regular mail and fax.

Hickey stated the vehicles are used in the summer and they are put away for the winter because of them being diesel engines and his neighbors have seen him use them. 

Campbell read the letter from the Prosecutors Office stating that Hickey had threatened to sue the Township in Federal Court if the Trustees move forward on the ORC volition and they would need to hire another Attorney. Letter attached to the minutes.

Campbell stated if the Trustees went on Hickey’s property and consider the vehicles not to be junk then the issue is closed. Campbell stated the Prosecutors Office can not represent them because it would be a conflict of interest and the Trustees would need advice in an ORC case and they would need to hire their own attorney.

Campbell moved to postpone entering Hickey’s property Jenkins second Roll call Campbell yes Jenkins yes Hickey abstained.

Campbell moved to encumber $65,000.00 for legal fees and contact OTARMA of a lawsuit Jenkins second Roll call Campbell yes Jenkins yes Hickey abstained.

Campbell moved to encumber $25,000.00 for a retainer Jenkins second Roll call Campbell yes Jenkins yes Hickey abstained.

Jenkins will contact an Attorney and OTARMA.

Fire Report

Shinsky informed the Trustees that the old Life Pack was damaged and he had a quote from Physio for $1984.12 for a yearly service and maintenance. The previous EMS Chief did not think they needed a contract agreement with them if she would have the Life Pack would have been covered

Campbell moved to table this issue until the next meeting Jenkins second Roll call all yes.

Shinsky informed the Trustees that they are applying for grants and they need the paperwork filled out for Fire Indemnity Board by January 15, 2010.

Jenkins moved to adjourn at 9:25 p.m. Campbell second Roll call all yes.
