Regular Business Meeting
December 31, 2009

Jenkins called the Meeting to order at 7:00 P.M. Followed by the Pledge of Allegiance.

Jenkins announced the Meeting is being taped for the benefit of the Township.

Campbell moved to pay the monthly bills Jenkins second Roll call all yes.

Jenkins moved to approve November 23, 2009 Minutes Campbell second Roll call Campbell yes Jenkins yes Hickey abstained.

Campbell moved to approve December 7, 2009 Minutes Hickey second Roll call all yes.

Fiscal Officer Report

Fiscal Officer gave Jenkins the Road Crews Time Sheets and turned in letter addressed to Hickey. He read the letter and it stated that Phyllis Bauer resigned from the Zoning Board of Appeals.

Jenkins asked Jackie Starkey if she was interested in the vacant seat and if she had any zoning violation against her. She stated yes that she was interested and there is no zoning violation against her.

Hickey stated he would like to see the position posted in the paper and on the Community Sign.

Hickey moved to open the resumes on January 18, 2010 at Trustee Business Meeting. Campbell second Roll call all yes.

Fiscal Officer informed the Trustees that she has a copy of Chris Jordan’s drivers license for emergency snow plowing.

Fiscal Officer asked the Trustees to increase the appropriations because of EMS Grants that the township had received.

Campbell moved by Resolution to increase the appropriations Hickey second Roll call Campbell yes Hickey yes Jenkins yes.
Fiscal Officer gave the Trustees the invoice from ADS for the culvert pipe. The total cost for the material and fuel was $1838.68. The cost for the material on Twp. Rd. 350 was $734.74 and the restocking and fuel cost to have the pipe sent back to ADS was $1103.94.

Hickey moved to pay for the materials used on Twp. Rd. 350 the cost was $734.74 Campbell second Roll call all yes.

Campbell moved to table the restocking fee cost of $1103.94 until Gary is present at the meeting. Jenkins second Roll call all yes.

Trustee Report

Hickey turned in his OTARMA bond paperwork. Fiscal Officer informed the Trustees that Janice Steele turned in her bond paperwork.

Campbell stated Mr. Young wanted him to read the ORC that pertained to the violations against Hickey. Campbell read the ORC 505.713, 505.85 505.87and 505.871 Campbell stated those were ORC that had pertained to Mr. Hickey.

Campbell stated because previous issues that has happened with the Road Supervisor he would like to offer Mr. Shinsky the full time Road Supervisor position.

Campbell read the contract and it stated that Shinsky would be hired by contract for six years. The contract will be in affect starting January 1, 2010 thru January 31, 2015 Shinsky will be the full time Road Supervisor starting wages $15.25 per hr. and three weeks’ vacation per year and following the policy that is in place now for future promotions.

Campbell moved by Resolution to enter into the contract with Shinsky on December 31, 2009. This will be a legal and binding Contract. Jenkins second Roll call Campbell yes Jenkins yes Hickey no.

Jenkins announced they have received a Fee Agreement from Attorney John Good as the legal counsel for Sullivan Township concerning the opinion that the Board of Trustee’s received from the Prosecutors Office. Jenkins read the Agreement.

Jenkins moved by Resolution 123110-1 to enter into the Fee Agreement. Campbell second Roll call Jenkins yes Campbell yes Hickey abstained. Campbell and Jenkins signed the Fee Agreement.

Jenkins stated that the Board of Trustees needed to amend Resolution 120709-1 and change line 6 to access all expenses incurred during inspection removal cleanup and legal fees to the owner’s property taxes as prescribe by the ORC. Also to add Item 8 Campbell will manage all communications with Attorney Good and his office.

Jenkins moved by Resolution to amend the changes to Resolution 120709-1 Campbell second Roll call Jenkins yes Campbell yes Hickey abstained.

Jenkins moved by Resolution to amend the inspection date to January 23, 2010 Campbell second Roll call Campbell yes Hickey abstained Jenkins yes.
Jenkins moved by Resolution to encumber $25,000.00 from the General Fund to cover all legal fees concerning this matter of Sullivan Township vs. Mark Hickey. Campbell second Roll call Campbell yes Hickey abstained Jenkins yes.  

Public Concerns

Mark Schwab had a public records request for the fund status and fund summaries for Sept. Oct. Nov. Dec. Fiscal Officer will get him the records and the cost.

Residents concerns were. Posting open positions in the paper, the restocking fee for the culvert pipe returned to ADS. Spending Township funds on the ORC violation against Hickey

Jenkins moved to adjourn at 8:10 p.m. Campbell second Roll call all yes.
