Sullivan Township Trustee Attendance Mark Hickey Chairman Hickey called the meeting to order at 7:00p.m. Followed by the Pledge of Allegiance Hickey announced the meeting is being taped for the benefit of the Township. Hickey stated they approved the January 6, 2010 Organizational Minutes and the January 6, 2010 Regular Minutes. Trustees signed the Minutes. Hickey moved to approve December 20, 2009 Special Meeting Minutes Campbell second Roll call all yes. Campbell moved to approve December 28, 2009 Minutes Hickey second Roll call all yes Campbell moved to approve December 31, 2009 Minutes Hickey second Roll call all yes. Campbell moved to approve December 31, 2009 End of the Year Minutes Hickey second Roll call all yes. Hickey questioned the Unemployment for Ken Webb. Fiscal Officer will check on this issue. Campbell questioned the Winter Conference Hickey stated that Skinner the Zoning Inspector, Carol from the Zoning Board, and Fiscal Officer will all be staying in one room and one room for Hickey Campbell moved to pay the monthly bills Steele second Roll call all yes. Trustees signed checks #20473 thru #20501 checks void #20461 thru #20472. Public Concerns Claudia asked about the status of the lawsuit. Campbell stated he will address that issue later in the meeting. Rich Johnson questioned Steele about how the Insurance Company pays for Fire Coverage. Steele explained the procedure to Johnson. Johnson asked the Chief how much it would cost to put out a house fire. Chief Shelton stated about $2000.00 with just our Vehicles and that is not counting man power. Johnson stated if the Insurance Companies will pay for the Fire Department why would you need a levy. Steele stated if you have soft billing perhaps you would not need a levy because it is one of the ways to generate revenue. Johnson praised Chief Shelton and the Fire Department for the work they have done. Johnson stated why don’t everyone leave the Fire Department alone and let them run the department because they are doing a wonderful job and they are updating the equipment and putting in lots of hours. Hickey stated the reason for a levy is for the operating expenses, because you cannot depend on members go out and generating a lot of revenue and that is why levies are necessary. Carol Stasick got the information from the Fiscal Officer at the last meeting on the Census Bureau she stated she had talked to them about the pay and it ranges from $11.50 to $15.00 depending on the job you have. She explained after you take the test they decide where to place you. She stated they do not pay for places for training they would like the Community Room on April 26 thru 29, 2010 from 8:00 a.m. till 4:00 p.m. Hickey stated since it will be for Township residents for employment he suggested that the cost for the room be waived. Hickey moved to waive the cost of the room but they would need to sign the hold harmless agreement for the use of the Community Room for the two days to be determined by hold harmless agreement. Steele second Roll call all yes. Jenkins and the Trustees had a brief discussion about soft billing for the Fire Department. Hickey stated it would be like the EMS billing. Campbell stated when you say soft billing the way it is suppose to be done with the EMS billing the Township accepts whatever the Insurance pays. Campbell stated the Fire billing would be done the same way. Jenkins asked if you’re a non-resident would that still apply. Campbell stated by law you cannot forgive any bills outside the Township according to the Prosecutors Briefs. Jenkins had a public request as follows. List is attached to the minutes
Hickey asked the Fiscal Officer if Jenkins had turned in any of the items he was requested to turn in she stated not at this time. Jenkins turned in the Township Keys he stated as far as the Trustee Source Book he turn it in to Sue Dembow because it was a 2006 and it was out dated. Hickey asked the Fiscal Officer if she had given them the books. Fiscal Officer stated she gave all the trustees new books before she came into office in 2008. Hickey stated the Zoning Book that was given to him by Peggy Skinner, Jenkins stated he has not received the letter. Hickey asked the Fiscal Officer to make a copy of the letter and give it to him. Jenkins received a copy of the letter. Fiscal Officer handed the Township keys over to Steele. Fiscal Officer Report Turned into the Trustees the Indemnity Minutes from John Brown Fiscal Officer advised the Trustees the Heater Core that was ordered was the wrong one and the Township would have to send it back at their cost to Valley Ford. Hickey stated he would take it to the UPS Store to be sent back. Fiscal Officer turned in a letter to the Trustees. Hickey read the letter it was from Robert Meadows Jr. for the alternate position on the Zoning Board of Appeals. Hickey stated Mr. Meadows stepped down from the alternate position at the Hawley Hearing on January 22, 2010 as not to jeopardize the Township. Hickey stated they need to check into the residence laws that have been thrown out in Cleveland and other places. Campbell stated there is a difference in Cleveland they are a municipality which is outside the legislative authority of the state. Townships are a part of Ohio’s legislative Body and Townships must follow the rules and specifications of the ORC. Hickey moved by Resolution 020110-01to send for a Legal Opinion to the Prosecutors Office about the residences requirements of someone who lives outside the Township and if they can be on the Zoning Board of Appeal or the Zoning Board of Commissions. Steele second Roll call Steele yes Campbell yes Hickey yes. Hartman stated he was at the Prosecutors Office and he had asked them the same question. Hartman stated it would be better if the Trustees got opinion for their board. Fiscal Officer gave Hartman from the Zoning Board of Appeals a copy of the transcripts from the Gingrich Hearing and the Hawley Hearing for their records. She also gave them the minutes from January 7, and 22, 2010 Organizational Meeting and a list of the Board Terms. Fiscal Officer gave Carol Stasick from the Zoning Board of Commissions and Skinner the Zoning Inspector a copy of the Hawley Hearing for their records. Fire Report Chief Shelton turned in for reimbursement for Emily Stewart of $70.00 for her National Registry Test on February 9, 2010. Chief Shelton announced the Cub Scotts will be touring the Fire Department on February 16, 2010 and 7:00 p.m. EMS Report Keith Rowe reported that they had five EMS runs and he turned them over to the Fiscal Officer. The Run Dates are as follows 1/20/10 thru 1/28/10 to be sent to Ohio Billing. Hickey asked about the gloves that was donated to Fox 8 for Haiti Rowe stated they were dropped off. Hickey asked if they got a received a receipt for gloves John Kenny stated the line was so long and it was a two hour wait in line and they was not stopping to give receipts. Campbell announced that he received a call from a lady from Akron Hospital about PEDS which is pediatrics. Campbell asked if anyone knows anything about it or if we have applied for anything. Chief Shelton stated it would probably be a car seat to strap in the other squad. Campbell stated they might be giving them out as a good will jester to the Departments that are in reach of their Hospital. Campbell will ask her to attend a Trustee Meeting when he talks to her. Zoning Report Skinner and the Trustees had a brief discussion about the Zoning Inspector’s Job Description but there are still some issues that need to be worked out. The Trustees will have a draft of the changes at the next meeting. Campbell asked who wrote the Job Description. Hickey stated it was Mark Schwab that was working on the Township polices at that time. Hickey stated the Job Description should have been looked into before the contract was enter into because it change the structure of the Job Description from an at will employee to a contracted employee. Campbell stated the Zoning Inspector has to follow the Job Description and it states the Trustees have the right to change it as deemed necessary. Skinner informed the Trustees about Junk Yards and Salvage Yards that they are only permitted in the Industrial Zones and that would be under a Conditional Use. Skinner stated she has been in contact with the Sheriffs Officer and according to them there will not be any Junk Yard permits issued to anyone who does not come into compliance with the Township Zoning. Skinner stated that there have not been any permits issued this year. Skinner stated that Sergeant Simms drove by some of the places and the people that have junk in their yards do not have permits. Skinner stated the Sheriff’s Department will be getting a certified copy of our Resolution Book and they will not issue any Junk Yard Permits in any Township if the people do not come into compliance with the Township Zoning. The Sheriff’s Department has agreed and they will work with the Zoning Inspectors on this issue. If they do not have a certified copy of your Book then they are not aware of what your Zoning Resolution is. Skinner asked the Trustees how to handle the Real Estate Company’s and Appraisers that wants a copy of the Resolution Book. Steele stated just tell them to download the book of the web-site. Steele will rewrite the Zoning Job Description and present it at the next meeting for approval. Road Report Shinsky turned in a list of what the road department needs. The list is attached to the minutes. Shinsky turned in a copy of the culvert markers that are needed on all the roads. Shinsky stated there are 47 signs and 46 posts. Shinsky stated they would be 50 post seven feet long. Cost $332.50 and 50 culvert markers signs. Cost $500.00 Campbell moved to purchase the posts and culvert marks Steele second Roll call all yes. Shinsky informed the Trustees that they need Oil Dry. Cost $4.75 per bag. Shinsky stated there are 50 bags on a pallet but he did not get a pallet price. Shinsky stated the Fire Department needs some also and they can split the pallet 25 for Road Department and 25 for the Fire Department. Shinsky will talk to Seth at Santmyer to get the pallet price because it would be cheaper than buying it by the bag. Hickey asked Shinsky if the signs are high reflector signs. Shinsky stated yes. Shinsky stated the Children at Play sign has been put on Twp. Rd. 350 he also stated where the other signs will be put up. Shinsky stated the White Dump Truck needs repaired. Hickey stated the truck has a crack in the sub frame that needs repaired. White from Amp Tec looked at it and gave a quote for the repairs of $750.00. Hickey moved to have the repairs done the cost $750.00 Steele second Roll call all yes. Shinsky will call Amp Tec to take the truck in. Shinsky informed the Trustees the Backhoe is leaking oil from the right rear end and it needs to be looked at. Gary stated Southeastern is the ones that work on the equipment. Hickey will see about getting a service man to come here. Shinsky stated the hoses on the bucket need to be repaired. Hickey stated if they work on the Backhoe then Southeastern can replace the hoses. The Trustees and the Road Crew discussed when they should be greasing the Red Dump Truck and they should not be lifting the bed up with the spreader box on and loaded. Hickey stated that is dangerous because the bed could come down even with it blocked up it could snap the 4x4 and fall. The Trustees discussed the Red Pickup Truck and the transmission that needs to be replaced. The cost $1500.00 they also discussed the Brakes, Reese Hitch, and the Shocks that need to be replaced. Total cost $2500.00. Campbell asked what happened to the Hitch. Hickey stated it got damaged. Hickey asked Gary to fill out an Equipment Damage Report. Gary stated he will Campbell moved to spend up to $2500.00 for the repairs at Harrison Ford. Steele second Roll call all yes. Trustee Report Steele stated the order was not placed for the signs for South View Cemetery, but the signs were there. Steele presented the order form of what the signs would look like but there were some corrections on the verbiage. Steele will make the changes and send it to Judco. the cost $100.00 Campbell moved to spend $100.00 for the signs at the Cemetery Steele second Roll call all yes. Steele stated the Community Room Sign has been damaged and the replacement estimate for the top panel is $375.00. Steele stated the sign is not on the Insurance. Campbell moved to add the sign to the Insurance the cost $6000.00 Hickey second Roll call all yes. Steele stated she got a price for an extra set of letters for the sign. The cost $75.00 but they would need some extra letter that would cost more. Campbell moved to spend $110.00 for the letters Hickey second Roll call all yes. Steele discussed getting a light at the corner of Co. Rd. 281 and Us Highway 224 the Trustees had no problem with her contacting L.M.R.E. about a proposed light. Campbell addressed the question that was asked by Claudia about the lawsuit. Campbell stated it is not a lawsuit it is a violation of the O.R.C. Campbell stated he had talked to Attorney Good and that they need to set a dated to meet with him and set a date and time to go on to Hickey’s property to look at the vehicles in question. Campbell stated he can set the date and time he asked Steele if she would second it. Steele stated she has been advised through the Ethics commission that she should not take a stand one way or another on this issue. They gave her a paper to refer to until she gets it in writing the paper was the O.R.C. 102.03 it is clear that she should at this point not take a stand because it has been referred to the Legal Department because of her involvement in 2008 as the Zoning Inspector. Steele stated she would have to abstain from anything regarding Mark or the Township. Campbell asked Steele then you cannot have any vote on any Zoning issues in the Township. Steele stated no on this particular issue it was specifically directed to the Ethics Commission Board. Steele stated until she receives something from the Ethics Commission she should abstain from any vote or comments regarding this issue. Campbell stated he was not at the meeting with CSX and he asked if they had discussed anything with the public about the meeting. Hickey stated Steele addressed that at the last meeting and the probability now is put in a new road to connect Twp. Rd. 150 south s of tracks to Twp. Rd. 391. Hickey stated they are in the process of talking to the owners of the property. Campbell asked Hickey if he had heard anything from Rusty. Hickey stated no not for a couple of weeks. Steele asked Campbell if he received a copy of the proposal he stated yes. Campbell stated that CSX was now saying they are going to extending the road south of the tracks to connect with Twp. Rd. 391 and replacing the bridge on Twp. Rd. 391. Campbell stated CSX has notified the County Commissioners that they will retain ownership of the Bridge on Twp. Rd. 391and that would take the County out of it. Hickey turned in his Ohio Township Trustee Source Book and asked the Fiscal Office to sign that he turned it in. Fiscal Officer signed that she was in receipt of the book. Hickey stated he did not need it back and that he had made his own personal copy of the book. Hickey stated there is a company called Gatherco putting in gas lines through the Township and the last time he talked to the gentleman he was going to send a drawing of where their lines are located in the Township to find out if it would be listed with OUPS when someone calls in have them located. Hickey stated the majority of them are on private property but there are some on the edge of the Township roads. Hickey handed in the copy of where they are located and they will not be putting anymore in. Hickey stated Columbia Gas has repaired the broken gas line running to the Community Room. The Trustees and Chief Shelton had a discussion about the Motor Vehicle Report that is required for OTARMA and about a levy to go on the May Ballot because they are running out time to get it on. Chief stated the Fire Department does the Motor Vehicle Report on anyone that comes on the Department. Hickey stated he would like to see a ¾ M levy go on the Ballot. Hickey stated he thinks the residents would go for that. Chief Shelton stated the economy has not change since November of last year and he thought we should wait and put the levy on in November instead of May. That way we would have time to work on everything and have it ready to be placed on the Ballot. Steele stated they do have a policy but there is no schedule A with the policy. Steele asked the Fiscal Officer if she found one. She stated no. Chief Shelton stated there would have to be a waiver for everyone to sign stating that their information can be released. Trustees had a discussion with the Chief. They asked if the Chief had they heard anything from the EMA Director about any reimbursements to the Township for the equipment that was lost because of the spill on St. Rt. 58. Chief Shelton stated everything has been turned in to him for the equipment and the damaged turnout gear and they are waiting for him to get back with them. Shinsky asked if a work order form could be drawn up. Campbell stated they can get one drafted to be adopted. Campbell stated that would be a good idea and that why there would not be any misunderstandings. Skinner turned in Jerry Sayles keys to the Fiscal Officer. The Fiscal Officer will turn them over to Jackie Starkey the Secretary on the Zoning Board of Appeals at the next meeting. Campbell moved to adjourn at 9:40 p.m. Steele second Roll call all yes.
