Sullivan Township Trustee Attendance Mark Hickey Chairman Hickey called the meeting to order at 7:00 p.m. Followed by the Pledge of Allegiance. Hickey asked that all cell phone to be turned off or put on vibrate. Campbell was not present at the meeting because he was in Paramedic Class. Hickey announced there has been a lot of talking in the audience during meetings. Hickey stated the Fiscal Officer is having a hard time recording the meetings and asked that we all show a little respect to her and to the Board of Trustees. Fiscal Officer stated she is not trying to be rude but I have a responsibility to take the minutes as correctly as I can but it is difficult to get every included if everyone is talking. Fiscal Officer thanked everyone for their understanding on this issue. Hickey announced that the trustees wanted to welcome Dave and Jean Field from England. Since 2003 England has been the sister city to Sullivan. Hickey asked if anyone wanted to speak now just in case we have a long meeting. Justin Simonson stated Rowe turned a request for mileage at the last meeting. He asked if any decision was made on the request. Hickey stated at the present time the Township is not paying any mileage on trainings. Simonson stated that there was a resolution at the last meeting. Hickey and Steele stated yes there was. Hickey asked Simonson if he had an agreement with anyone that his mileage would be paid before he started his class he stated no. Then he stated that he did not have an agreement that it would not be paid. Simonson stated mileage was paid in the past for anyone going to class. Hickey stated at that time there was money coming from the Fire and EMS levy but the money coming in is very limited. Steele stated we do not have the levy now so we do not have the money to pay mileage. She also stated that the one reimbursement was pre arranged last September. Steele stated they honored that but after that there are no more reimbursements. Hickey asked Chief Shelton if he had any input on this issue. Chief Shelton stated Rowe did not get paid and you will not get paid. We just do not have the money. Steele stated we have put a freeze on all reimbursements and expenses. Chief Shelton stated the resolution was passed because the County Prosecutors stated in an opinion that the Trustees do not have to pay mileage reimbursements. Fiscal Officer Report Hickey asked the Fiscal Officer if there were any checks out of the ordinary. She stated yes, one from Thomas West for an Ohio Planning and Zoning Law Book cost $178.00. Steele moved to pay the monthly bills including the one for Thomas West for $178.00 Hickey second Roll call all yes. Trustees signed checks #20739 thru #20773 and Purchase Orders #104 thru #106 Fiscal Officer gave the Trustees the Road Crews Time Sheets and checks to sign. Hickey stated they will wait until the Road Report comes up. Steele and Hickey stated the Fiscal Officer did an excellent job preparing the minutes considering the difficulty of the meeting. Steele moved to approve June 7, 2010 minutes Hickey second Roll call yes. Fiscal Officer stated she had received phone calls from residents on Twp. Rd 581 near Co. Rd.40. She said they seemed very unhappy because of the bad conditions of the road. They stated that the road is breaking up and needs to be repaired. The Road Department received the same calls. They wanted to know what the Trustees were going to do about the road. Hickey asked Steele if she had any thoughts on the issue. Steele asked if the road could be ripped up and graded and whatever else needs to be done to get it ready for chip and seal next year. Hickey stated that would be a start but the first thing that needs to be done is ditching. Hickey stated he was told by some of the residents that they think it might be the tree causing some of the road problems. Gary stated it is not the tree but since he has opened the east ditch the water is now draining from under the road. Hickey stated that he agrees with Gary, but there is still ditching that needs to be done. Hickey asked Gary how he came up with the calculations for the stone that was needed for the project on St. Rt. 58 Twp. Rd. 581 north to Co. Rd. 40. Gary stated he got the formula from Denny Finkal. Hickey and Gary discussed how much of the road needed to be raised. For a 1000’ section and the material that would be needed. Gary stated the following. 600 tons of 304’s, 200 tons 411’s, and 500 gals of dust bond He also talked about the equipment that will be needed. The Road Grader, Dump Truck, Roller and Backhoe a copy of Project Work Sheet is attached to the minutes. Hickey asked Gary if all the materials were going to be delivered to the job site. He stated yes, if Bartley and Bolin will bring it. Hickey stated they agreed to tailgate the stone and he told Gary he will have to call and schedule the day he needs the stone delivered. Gary stated Shinsky talked to Donna at Bartley and Bolin and she told him they would not tailgate in a Semi. Hickey stated that the stone would be spread from their quads. Hickey stated he will contact them to see what the problem is. Fiscal Officer informed the Trustees that they had copies of L.M.R.E. for a meeting and a trade show on July 20, 2010 at 6:00 p.m. they was asking for a non member of the co-op to vote for a Trustee. The Trustees can appoint someone that is not on the co-op Hickey stated he would like it to be someone who lives in the Township to cast their vote for Sullivan. Steele stated that Shalon her daughter lives in the township and she is not a member and she would ask her to represent Sullivan. Fiscal Officer turned in the monthly reports from Ohio Billing to Chief Shelton for Keith Rowe that he receives on a monthly basis. Fiscal Officer gave Schwab his records request for mileage that was turned cost .10 Fiscal Officer stated there were two A&W Direct magazines and she gave one to Gary and one to Steele. Fiscal Officer informed the Trustees that received a check for $1350.00 from OTARMA it was for a discount on the OTA Membership. Fiscal Officer announced Steele turned in her certificate for the public records class she attended. Fiscal Officer informed the Trustees that she gave each of them a copy of the Sunshine Law Book. Fire Report Chief Shelton read a Thank you card. It stated that the EMS Staff made them feel very comfortable and they look forward of seeing the stork on the squad. EMS Report No Report at this time. Zoning Report Skinner announced that the Zoning Board of Commission and Gary from the Zoning Board of Appeals, the Zoning Inspector and the Fiscal Officer attended the seminar at the Prosecutors Office. It was hosted on June 17, 2010 and it was about junk and wind turbine Regulations. Hickey asked who attended. Skinner stated Bud Jantz, John Storch, Carol Stasick, Jean Reams Rich Johnson and Gary. He was the only one from Appeals Board. Trustee Report Steele talked about getting the proper shirts for the Road Crew in lime green. She stated she found some for $16.95 and some for $14.99 at A&W Direct Book. This issue was tabled until the next meeting when she can research it more. Hickey turned the signed Verzion Cell phone agreement, Ohio Billing agreement, and the American Red Cross agreement for the Fiscal Officer to mail. Road Report Hickey asked the Fiscal Officer if the Road Department turned in a list of all their personal items that are in the Township Garage. She stated no not at this time. The Road Departments list of materials is listed below.
Steele asked Gary who does all the calculation. He stated that he does. Steele stated you do the calculations and the formulas for all the materials that are needed on the job projects and Shinsky just writes everything down on the paper. Hickey asked who drew the map. Gary state Shinsky did. Hickey stated that Shinsky drew the maps incorrectly. The lines show the roads are off and on the wrong side. Hickey asked why they were not using the maps that were made up. Gary stated he did not have copies of them. Hickey stated there are four maps for the township roads and the fifth map is for the roads in town. Hickey asked Gary to start using them. Hickey turned the maps into the Fiscal Officer she will make copies. Hickey stated he received a call from Anna Storch a while back. Hickey asked when the repairs by her home will be completed. Gary stated as soon as they get the grass cut they will grade the dirt level and put a swell and get grass planted. Hickey asked Gary why they did not take care of it before. Gary stated because it was too wet and then they were working in the Cemeteries. Hickey asked Gary what does he want him to tell her when he calls her back. Gary stated they will be out there and get the grass cut down next week and mow the ditches and they will be out there next month to resolve the problem. Hickey will call Anna. Hickey stated he had asked Gary in a meeting on June 7, 2010 if the Township had done any culverts where someone had reimbursed the Township. Hickey asked Gary about Hadley on Twp. Rd. 462 on May 9, 2010 he paid the Township $750.00 for a new culvert replacement and filled the form out so the township did them under your watch. Hickey stated Gary and Paul had put the culvert in. Hickey stated so we have done it in the past but we will have to wait until we get the opinion back from the Prosecutors Office. Steele asked if it was approved in a meeting. Hickey stated he did not remember. Steele stated there was a conversation about the pipe but she did not remember until she went back and looked at her notes and read the minutes. Hickey asked who determined it had to be a 15” pipe. Gary stated he didn’t he was on vacation when the pipe was ordered. Gary stated there was not a culvert there before. Hickey stated they changed the flow of the water which cut of the way they entered their property. Trustees and Gary had a discussion about the water flows on Twp. Rd. 391 and Co. Rd. 500. Gary stated he did not change the way the water flows. Steele will go over the opinion from the Prosecutors Office on Twp. Rd. 150 Hickey stated that he ready to release the opinion? He stated we will discuss this issue at the next meeting. Hickey asked if all of the culvert markers are up. Gary stated he can’t answer that question they would have ask Steve. Hickey stated he did not sign the last time sheets for the Road Department because Gary had claimed a half hour overtime working in the Cemetery. Gary stated he was almost done and he wanted to finish up so he would not have to go back. Steele stated you’re not supposed to have overtime and you should have called someone and notified them of the issue. Gary and the Trustees had a lengthily discussion over the time sheets and how they are being filled out. Hickey stated that he just don’t know why it takes them so long to get out of the garage and get to the job. Hickey stated if Steele wants he will sign the time sheets. Gary stated he busts his butt out in the heat and the Trustees want to nitpick over a half hour and not sign his pay check. Hickey stated they have asked them to write down what time they leave the shop. Hickey stated the time sheets need to be filled out when they go from job to job so they know how long they spend on the job site. Hickey stated Shinsky put down a half hour overtime for a squad call and Gary did not and had a half hour overtime in the Cemetery so they don’t add up. Hickey announced there will be a five minute break while he goes through the time sheets to give to the Fiscal Officer. Steele announced this issue was on the table several meetings ago and she has done a lot of research and extensive conversation with legal counsel. Steele stated she doesn’t take decisions lightly but for a number of reasons that she believes it best for the Township we have issues with Shinsky in refusing the drug test and there has been numerous unfounded accusations and there have been a number of things they discussed prior in Executive Session and for the best interest of the Township. Steele moved to terminate Shinsky contract which terminates him. Hickey second Roll call Steele yes Hickey yes. Hickey stated he and Steele will meet at the garage at 7:00 a.m. to let him know and get the Township keys and any other Township property he has, and give him the opportunity to collect whatever personal property he has in the garage. Hickey stated Steele and Campbell can sign Shinsky paycheck. Steele and Hickey signed Gary’s paycheck. Hickey stated the Road Crew needs to be specific when filling out their time sheets about what they are doing. Hickey stated documentation is what he wants to see on the time sheets. Steele stated from this point on no one will intimidate her any longer because she will not tolerate it. Steele stated no one will intimidate anyone on the board either. Hickey moved to adjourn at 9:50 p.m. Steele second Roll call all yes.
