Regular Business Meeting
September 20, 2010

Hickey called the meeting to order at 7:00 p.m. Followed by the Pledge of Allegiance.

Hickey asked that all cell phones be put on vibrate or turned off.

Trustees signed the September 7, 2010 minutes

Trustees approved the minutes for September 8, 2010 with one correction of date of August 8, 2010 Steele moved to table the minutes until the date is corrected Roll call all yes.

Campbell asked if more dust bond was ordered. Hickey stated yes Gary used the last of it in August. Gary stated there is 1400 gals left. Campbell asked Gary if it will be out of the tank before winter. Gary stated yes.

Campbell moved to pay the monthly bills Steele second Roll call all yes. Trustees signed checks #20844 thru #20856 and Purchase Orders #119 thru #124.

Hickey asked Gary about the Dexter invoice on the mower and if he sent some of the parts back. Gary stated yes he did. Fiscal Officer gave the invoice to Gary to review.

Hickey tabled the Dexter invoice until they can get clarification from Dexter Campbell second Roll call all yes.

Hickey had questions about Gary’s time sheets. Hickey told Gary on September 13, 2010 he had a half hour over time that was not authorized by him. Hickey asked Gary how he got the half hour over. Gary stated when he came back to the garage to unload the brush from trimming trees it was 4:00 p.m. Gary stated he removed it on Friday. Hickey stated that is not what you have documented on your time sheet. The time sheets has eight hours 7:00 a.m. till 3:30 p.m. Gary stated he took the half off on a Friday. Hickey told Gary he still has to call him.

Hickey stated that on Gary’s time sheet it shows he talks to the Cornwell man and the Township doesn’t deal with them. Gary stated it was personal. Hickey stated the Township shouldn’t be paying him to talk to the Cornwell man. Steele suggested he talk to him on his lunch break. Hickey stated he would like to see him start on Tuesday’s at 7:30 a.m and schedule the Cornwell man at 7:00 p.m.

Hickey stated that on September 17, 2010 Gary went to check the battery on the tanker with Les. Hickey asked the Trustees if they were paying him to do maintenance on the Fire Department Equipment. Campbell stated he can’t see anything wrong with that it’s for the safety of the Township. Hickey stated he noted it on the time sheets the Board had discussed all the issues.


Fiscal Officer Report

Fiscal Officer had a letter from Ohio Department of Transportation District of Ashland. Hickey read the letter it explained the Rural Consultation Process. Hickey stated he will attend the meeting on October 6, 2010 10:00a.m. Until 6:00 p.m. Fiscal Officer will make copies for the Trustees.Hickey stated he will report back to the Board on what it was about.

Fiscal Officer also gave a letter that is addressed to Steele from Absolute Roofing. Steele opened the letter it was the contract for the school roof. Campbell asked if the township had received his workers compensation and proof of insurance. Steele stated she didn’t know but she will contact them.

The trustees tabled the signing the contract with Absolute Roofing until we have their paperwork on file.

Fiscal Officer informed the Trustees they had copies of Dale Muetzel’s paperwork for where he attended Paramedic Class and for mileage, books and National Registry. Steele tabled the mileage issue. Hickey stated there was no mileage because it was after the motion was made no mileage will be paid.

Steele moved to pay for the books and National Registry cost $293.76 Hickey second Roll call Steele yes Hickey yes Campbell yes. Campbell stated that he believes the Township is responsible for the mileage.

Hickey stated that the documents show that he has passed the class and is now a Paramedic.

Fiscal Officer had the Resolution #090710-05 that Hickey asked the Fiscal Officer to bring so they can sign to support the vacating of Twp. Rd. 150 east of the Hubler Cemetery as recommended by the County Engineers.  The Trustees signed the resolution. Campbell didn’t sign the resolution because he was not present at that meeting. Fiscal Officer will make copies.

Fiscal Officer stated they need to have an Executive Session for Ohio Billing and legal matters. Hickey asked the Fiscal Officer if we can do it at the end of the meeting she stated yes.

Riley stated that Mark Schwab had told the Fiscal Officer that trustee Steele gave him money for the DVD’s. Riley asked her Steele if this statement was true. Steele stated yes she gave him money and three DVD’s

Fiscal Officer had a brief discussion with the Trustees about the cell phones from Verzion and about the government plan that she had a call in about. Fiscal Officer stated if she does not hear from them soon then she will go to Ashland and pick them up. Fiscal Officer asked about getting the military phone for Gary if it is free. Fiscal Officer will try to get this issue taken care of.

Steele turned in a check that Les received from the Insurance Co. for $5.00 for a fire report. Steele stated we need to send it back because we have nevered charged for a fire report before. The Trustees agreed. Fiscal Officer will send the check back and let them know we do not charge for a report.

Campbell asked Steele if Chief Jeff Shelton has contacted her about his status as the Fire Chief.  Steele stated he had called her before the last meeting and asked if he could talk to the Trustees about his letter of resignation. Steele stated she brought the issue up at the last meeting and it was her understanding that he was going to attend tonight’s meeting. Steele stated she has not talked to him since.

Campbell stated he is chief until September 22, 2010.  Campbell stated as of Wednesday the trustees can start looking for a new Chief. Hickey stated he is not prepared to choose a Chief at this point.

Campbell stated that he attended the Fire Department meeting and they made it clear who they support as the new Chief.

Hickey stated Gary was the Chief before and they replaced him before. Hickey stated he thought it would be in the Townships best interest if they do not install Gary as the Chief.

Campbell stated that Gary has the support of the Fire Department. Steele stated how about they do a probation period of 90 days. Hickey stated he is not willing to do so.

Steele stated she is willing to give Gary a chance because everyone has spoken and she talked to Les at great lengths. Steele stated she would be willing to accept their suggestion on a probation period and there would have to be massive improvements in the Fire Department and that is her biggest concern.

Campbell stated if they did appoint Gary it would only be until the Organizational Meeting then you can reappoint him or go in a different direction.

Steele stated she would need a lot of corporation and respect from within the Fire Department that we have not had in a long time.

Campbell stated the reason for paying a Chief $300.00 is because there is a lot of work and responsibility to do the paper work to receive grants. Campbell stated in the last few years there has been a lot more responsibility to maintain the Fire Department records because they are now in the records room.

Steele stated she is willing to do the probation period from September to the Organizational Meeting. Steele stated she wants everything reported to the Trustees and that has not been done in the past. Steele stated that the Fire Department minutes are missing and the minutes that we have do not reflect what went on in the meetings.

Steele stated the Fiscal Officer provided a tape recorder to the Fire Department and it has not been used. Fiscal Officer stated Chief Shelton gave it back to her and she gave it to the Zoning Board of Appeals in a Trustee Meeting. The recorder was given to Gary. Steele stated she was sorry that she lost track of the recorder.

Hickey asked if Steele was talking about the November 4, 2009 Fire Department minutes that had some issues in them. Hickey asked the Fire Department Members if the minutes had been approved. They stated it was just the sentences that was in the wrong places or should not have been it the minutes. Hickey asked the Fiscal Officer if she could get a copy of them from the public records. Fiscal Officer stated she would.

Steele stated that the minutes she looked at has no signature on them stating that they have been approved. 

Steele moved based on her conversation with Les and what some of the members have said. Steele told Gary it will be on his shoulders to prove himself to her and that the probation period will be from September until the Organizational Meeting Campbell second Roll call Campbell yes Steele yes Hickey no.

Wolfe asked if it was going to be a paid position. Steele stated she didn’t include that in her motion.
Wolfe told Gary not to take it because they were paying the last Chief. Steele stated as far as the probation period goes Gary would have to prove to her that he could do the job and she is not willing to have it as a paid position. Hickey stated let the minutes reflect this is an unpaid position. Gary asked if it would be a paid position if he proves himself. Steele stated they will talk about paying a Chief at the Organizational Meeting. Gary stated he was not interested in the position under those terms.

Gary stated a chief was brought in and paid and Gary stated that was the Chief before with no pay and that he was railroaded by the Trustees. Gary stated he is willing to take a chance. Gary stated that Mark Hickey knows what happened. After some discussion Gary stated that he will not take the Chief’s position.

Hickey stated Gary already gets paid. Gary stated only when he is working for the Township and he responds to emergency call.

Les stated when you get a job and you are on a probationary period you get paid.

Campbell asked Hickey what his position on the issue is. Hickey stated he would like to see a District set up. Trustees had a brief discussion about a Fire District.

Gary stated that the pump on 2711 has must be certified every year and it has been two years since the pump was certified. Campbell stated that he wanted to verify that because they would have to notify them.

Hickey asked if there has been a hose test and a ladder certification. Gary stated he didn’t know. Hickey asked about the face mask fitting and if they have been checked. Gary stated two years ago. Hickey asked Gary if they went over the Command Unit when it came back. Gary stated no it was in the parking lot at the Community Room when he came to work on Monday. Gary stated that he and Les was going to do the inventory after the meeting on the vehicle.

Campbell asked Les if he would be the Interim Chief. Les stated yes with the help of Bob and Gary. Keith told Gary that he would still handle the EMS for him.

EMS Report

Rowe wanted to thank Steele for putting him in contact with a lady named Zole. She came in when the EMS was having training. Rowe stated it was a very good training about an Exterior Wearable Defaulter for heart patient and the EMT’s was not trained on this device. She informed them of how it works and what to look if this situation ever comes up with a patient.

Rowe asked the Trustees about the letter of resignation from Chief Shelton. Rowe also wanted to know if the Chief could withdraw his resignation at any time until the end of his resignation date.. Rowe asked if the resignation was just for Chief or from the Fire Department as a whole. Hickey stated that he does not know what is going on because they were expecting him at the meeting tonight.

Rowe stated as far as the transportation issue go are they allowed to use the Command Unit since its back in the Township. He wanted to know if it can be used for the people that are going for training and school. The trustees had no problem with this issue and the Command Unit can be used for training.

Hickey stated he wanted a mileage and an activity report that Shelton was supposes to be handing. Rowe asked the trustees about putting note paper in the Command Unit for mileage or a note book with three columns that would consist of driver, starting mileage, and remarks column.

Steele asked the Trustees about her designing a form for the Command Unit. They stated yes that would be fine.

Rowe turned Run Sheets #103 thru #108 dated September 10 thru September 20, 2010 #104 no transportation.

Fire Department

Hickey stated he would like to inspect the Fire Department vehicles and have an open house for the public. Hickey asked about putting it in the paper under local briefs for the Open House Fire Department Tour public welcome.

Hickey moved to have a special meeting on Friday September 24, 2010 at 7:00 p.m. for the Open House Fire Department Tour Steele second Roll call all yes.

Steele moved to hold Halloween on October 30, 2010 from 6:00p.m. - 8:00 p.m. Campbell second Roll call all yes. Fire Department will be doing Traffic Control. Steele asked for it to be put on the sign.

Road Report

Gary stated he needed 75 culvert markers and oil filters. Hickey asked Gary how much they cost. He stated he didn’t know but he needs them for Twp. Rd. 350,462, and 581. Hickey asked if he was putting any on Twp. Rd. 150. Gary stated there all up. Hickey told Gary except for the one down by C.O. 281 that he took out with the mower. Gary stated he will put that one up by the big culvert.

Hickey asked Gary about the filters for each vehicle and if you use one then you order another one.

Gary stated he was told he was spending too much money and everything needs to be changed. Hickey told Gary that he needs to have everything serviced before winter gets here. Hickey asked Gary how many filters he needs Gary stated what is on his list.

Campbell moved to purchase the filters Hickey second Roll call all yes.

Hickey asked Gary if he will have the filters on the shelves this week; Gary stated yes he had order two sets for everything.

Hickey asked Gary what he was doing with his used oil. Gary stated it’s in the drums at the garage two 55gallon drums.

Hickey moved to purchase a 55 gallon drum of oil $525.25 Steele second Roll call all yes. Gary will order the oil.

Hickey moved to purchase 75 culvert markers up to $1000.00 Steele second Roll call all yes. Gary will order the culvert markers.

Steele stated she received two complaints. One was from Scotty and came from Rich Johnson about the holes on Twp. Rd.150 and a hole on the north side of the railroad bridge on Twp. Rd. 391.

Hickey stated that the seat for the mower came in today and it was under warranty. Hickey stated if they get it on he will pick it up on Wednesday.

Hickey stated he told Gary he took the Red Dump Truck to Finks to get it checked out. Hickey stated Fink thinks the truck needs a steering gear box to recondition and he figures it could be about $1000.00 for the steering gear and a few hoses.

Campbell moved to have the steering gear box repaired Hickey second Roll call all yes. Hickey stated he will contact Fink.

Campbell moved to spend up to $2500.00 to fix the plow for the White Dump Truck Hickey second Roll call all yes. Gary will make arrangements to take it to Amp Tech.

Hickey stated when he brings the mower back he wants to get with Gary and look over the spreader box.

Campbell moved to spend up to $1500.00 on the repairs for the spreader box Steele second Roll call all yes

Hickey stated he and Gary will go over the list of supplies before they are ordered.

Hickey turned in his certificate for attending the Public Records Class.

Hickey stated Lytle has done the skim coating on Twp. Rd. 350 and completed the repairs half way between Twp. Rd. 581 and Co. Rd. 681 and has completed the repairs on Twp. Rd. 462.

Hickey moved to spend $5000.00 for 100 tons of #8’s and 50 tons of #304’s stone for the Township Roads Steele second Roll call all yes.

Hickey stated he talked to Dennis at Sauver and Hickey thought it would be in the Townships best interest to have a contracting project by a different contractor so the Township can see the different methods. Hickey asked him to look at Twp. Rd. 150 east of S.R. 58. Hickey stated they will mark out the areas for the repairs and when he reaches the maximum amount that the trustees have stated for the job then he can stop.

Campbell stated he don’t know if this is legal because the trustees  have a bid proposal that was never discussed in a meeting from Sauver for $26,000.00. Campbell stated anything over $25,000.00 has to be put up for bid. Hickey stated they put the bid in the paper and Saver’s quote came in a day after the bids was opened.

Hickey stated he was actually $4.00 less per ton than anyone else. Trustees had a brief discussion about the road material. Hickey stated Sauver will use more material for less money.

Hickey moved to contact Sauver to have him come in October 1, 2010 and start on Twp. Rd. 150 but if the weather turns bad they will have to shut him down. The Hickey approved up to $10,000.00 of hot mix repairs by the process specified in his proposal. Steele second roll call Hickey and Steele yes Campbell abstained.

Public Concern

Skinner stated she will take care of the sign Hickey stated she would have to communicate with the Fiscal Officer because she would have the information. Skinner stated that we will be able to work together.
Hickey moved to enter into Executive Session at 9:17 p.m. for the purpose of Ohio Billing for EMS issues and Legal Opinions Steele second Roll call Steele yes Campbell yes Hickey yes.

Hickey moved to enter back into the Regular Session at 9:30 p.m. Steele second Roll call Steele yes Campbell yes Hickey yes.

Hickey moved for Ohio Billing to forgive five residents Steele second Roll call Campbell yes Steele yes Hickey yes.

Hickey moved on the Legal Opinion there was no action taken on the invoice from Mr. Schwab Steele second Roll call Steele yes Campbell yes Hickey yes.

Campbell moved to hard bill for all EMS calls and all Fire calls Steele second Roll call Campbell yes Steele yes Hickey no.

Hickey stated Gary is only one person and we can’t kept spending months ditching 200’ ft. between him on Squad calls and lunch he is not able to get the ditching done. Hickey stated it’s been years and we still have the water problem in the same places.

Hickey moved that they advertise for culvert and ditching work of three sections of the roads Steele second Roll call all yes. Hickey stated he will write the ad also do the maps for the ditching as guidelines and the ad that will be placed in the paper. Hickey will give all the paperwork to the Fiscal Officer Wednesday night.
